What is the Minnesota Transfer on Death Deed by Married Sole Owner?

In Minnesota, transfer on death deeds are governed by Minn. Stat. 507.071.

While the statute provides a basic form, as well as overall content requirements, the state authorized the development of uniform conveyance documents for some specific situations. One such situation occurs when a married property owner holds sole title to the real estate he or she wishes to convey with a transfer on death deed. A correctly-completed basic statutory form is valid in most cases, but because the owner's husband or wife may be able to claim spousal interest in the property, these deeds require the spouse to sign a statement releasing any marital rights. Without this release, the non-probate transfer on death may not occur, and the property could revert to the deceased owner's estate for probate distribution instead. To prevent such unintended outcomes, there is a special deed for this circumstance.

This transfer on death deed form is for use ONLY by married grantor owners who are the sole spouse on the property's title.

As with other transfer on death deeds, this form must be executed and RECORDED during the grantor owner's lifetime.

Review: It would be helpful if there were a specific example of putting a deed into a trust. Also, the limitation of characters on the description of the property was not enough.

Review: Received the documents, but the explanation and process is not as straightforward as I would have liked. The Instructions and Sample document were not always easy to follow. I may just have a real estate lawyer perform the task.

Review: I am really impressed by this website. Not only is it affordable, but they give a detailed description, instructions, and an example to follow. Also there are additional forms included. And it's State, even county, specific. They do not require a subscription either as you can just order what you want. Thank you!

Review: Outstanding. There is nothing worse than finding the correct forms or having to hire an atty to do what most people can do on their own. I cant speak for all but these forms are fairly easy. The addition of guides and supplement forms are excellent. I just saved quite a bit of money with your site. Thanks

Review: Your instructions and sample are geared towards businesses. It would have been helpful to have included some for us individuals as married couples as well. I also recall one or two spelling errors on the form that I could not fix, and the instructions seem to be for a prior form. This particular registry also required a stamped self-addressed envelope for return of documents. Hey, you asked! Overall, pleased.
