In Minnesota, transfer on death deeds are governed by Minn. Stat. 507.071.

While the statute provides a basic form, as well as overall content requirements, the state authorized the development of uniform conveyance documents for some specific situations. One such situation occurs when a married property owner holds sole title to the real estate he or she wishes to convey with a transfer on death deed. A correctly-completed basic statutory form is valid in most cases, but because the owner's husband or wife may be able to claim spousal interest in the property, these deeds require the spouse to sign a statement releasing any marital rights. Without this release, the non-probate transfer on death may not occur, and the property could revert to the deceased owner's estate for probate distribution instead. To prevent such unintended outcomes, there is a special deed for this circumstance.

This transfer on death deed form is for use ONLY by married grantor owners who are the sole spouse on the property's title.

As with other transfer on death deeds, this form must be executed and RECORDED during the grantor owner's lifetime.

Contents were well done. Could not remove and replace the "Deeds/" footer, rendering the form unusable for filing with a court and county deed records. This should be corrected.

It all started out well, then I was abruptly told that I would have to submit the documents directly to the recording office. No explanation was offered and I wasted a lot of time on your website for nothing. Very disappointing, as the concept of e-recording is what is needed in 2026.

We reviewed your order and our support messages. The document uploaded for recording was a very low-quality scan that did not meet the county’s eRecording image requirements. Our staff asked that a clearer scan be uploaded, but the same image was submitted again.

Because the document could not be processed electronically, we advised recording it directly with the county recorder’s office.

E-recording systems require clear, legible document images that meet county standards. When those requirements cannot be met, recording directly with the recorder is often the fastest option.

The form was easy to fill out. The only problem I had was on the Notary page I live in a different state than the property and I couldn't change the name of the state or county where the notary had to sign.
