Missouri Notice of Intent to File a Mechanic's Lien

Mechanic's lien claimants who have not contracted directly with the owner (or the owner's agent) of the subject property must ensure proper notice is delivered to these parties before claiming a lien. In Missouri, the proper form of notice is a document called a Notice of Intent to File a Mechanic's Lien.

Every person except the original contractor shall give ten (10) days' notice before filing the lien, to the owner, owners or agent, or either of them, that he holds a claim against such building or improvement. R.S.M.O. 429.100.

The notice must set forth the party responsible for paying, identify the owner and lien claimant, the common name and address, and legal description of the subject property, a description of work or services provided including dates, the general contractor's name and address, and the amounts due along with any extras or past payment deductions noted. Id.

Any officer authorized by law to serve process in civil actions, or by any person who would be a competent witness may serve the notice. Id. When the Notice is served by an officer, his official endorsed return counts as proof of service. Id. If served by any other person, the fact of such service must be verified by affidavit. Id.

The service was prompt and attentive to my questions. I would've just appreciated a heads up that I also needed to contact the county directly (and provide contact info) to receive a certified copy of the document (Notice of Commencement) in order to submit the certified copy to the Building Department. This was an extra step that I haven't had to complete before using another eRecording service. Even if this extra step is a result of the county's system. I would still have expected a head's up (since there wasn't any info regarding this on the county's site for eRecording).

Came with all the paperwork that I needed plus a lot more paperwork than what I needed. Covered all the bases! The instructions were a big help. Easy fill in the blanks. Had no problem filing the paperwork afterword at the County Clerks office. Definitely worth the $20.

They must have busy when I applied. The screen said it should be done in under10 mins unless heavier traffic. I was a little nervous because of a time deadline. It was completed in 45 mins and for under $30 it was worth every penny to have my deed details at my fingertips. So I give it a 5 on ease of use and quick handling. You can get it done less expensively, but great in a time crunch.

I thought the forms were reasonably priced, the instructions included in the packet were thorough, and the examples helpful. Thank you for the additional CDR forms too. I contacted the Recorder's office via email with a question and Jennifer Bowser answered promptly. Job well done! However, when I delivered the deed and Real Property Transfer Declaration to the Clerk's office in Lafayette, the clerk was unfamiliar with the Declaration document being submitted and it took some time to convince her to submit the form without charging the recording fee. She even tried to phone the recorder's office for clarification, but no one answered. There then was an additional form at that office that I had to complete called Recording Request/Transmittal Form. I would suggest including that form with instructions in your on-line packet to speed up the process when a Deed is delivered to the County Clerk's satellite office. I do not expect every clerk to know all the particulars of recording requirements but a little knowledge wouldn't hurt.
