Preserving Lien Rights After Sale of Residential Property
When residential property is involved, lien claimants in Missouri must take precautions to ensure that their lien rights survive, even if the owner transfers the property by sale. Filing and serving a document called a "Notice of Lien Rights" will protect those rights.
Under R.S.M.O. 429.016(1), any person or entity who seeks to retain the right to assert a mechanic's lien against residential real property must record a notice of rights in the office of the recorder of deeds for the county in which the property is located, not less than five (5) calendar days prior to the intended date of closing stated in a notice of intended sale.
Failure to record the notice effectively waives and forfeits any right to assert a mechanic's lien against the property. R.S.M.O. 429.016(2). The claimant retains all other rights and remedies allowed by law to collect payment for work, labor, and materials. Id. So, all hope is not lost for those who miss the deadline, but they have limited their available options.
If a notice of rights is recorded after the owner's conveyance (sale) of the property to a bona fide purchaser for value (someone who buys without notice of a claimant's lien rights), it will not be effective to preserve the claimant's mechanic's lien rights to the property. R.S.M.O. 429.016(3).
The notice of rights must contain the following information as mandated by R.S.M.O. 429.016(8): (1) date of the document; (2) owner's name; (3) lien claimant's name including address; (4) a legal description of the property; (5) name of the person contracting with the claimant for work; and (6) names of persons performing work for or supplying materials to the claimant.
By properly completing and filing the notice in a timely manner, claimants can confirm that their lien rights are protected, even if the property changes hands during the time the lien is in place.

Extremely easy and fast recording of real estate records. I was impressed that it was less than 6 hours from the time I uploaded the document to Deeds.com to receiving confirmation that it was recorded by the county clerk. Everything went well except that any information that I typed in on the computer download moves upward so that the letters or numbers are somewhat elevated above the line that should be even with the words on the form. I think it will be acceptable to the county recorder, but I don't especially like to submit things that appear uneven. I asked for help but just received a robotic reply that said to take steps that I already had done.
So unless you know a way to correct this I likely won't use your forms again.

1) I was very pleased when the staff mentioned your service since the three referenced on the Recorder's website all wanted HUGE Account set-up and maintenance fees AND BIG fees per recording, and yours has no set-up fee AND nominal per-recording fee; 2) My (few) recordings will be NON-LAND Related, summary or entire record(s) of Administrative (Procedures Act) records, Other than the Border width and Cover Sheet, do you anticipate any other special requirements for such recording(s)? NOTE: I just sent one by Snail Mail, and they just informed me that due to the GERMIPHOBIA 'Pandemic' the ONLY open and record Snail Mail ONCE A MONTH On the first of each chmonth!

Really good product, included guide to filling out forms.
Totally pleased with that part.
Customer service however was terrible. Did not hear back after I sent two emails. The site signed me up but after I was accepted they would not allow me to download a form, with the notation my account was closed. Had to use another email. Had problems with that. Finally got off of site and went to a login site that allowed me to download the forms. If you can get past setting up your account, it is fantastic site. Nice price compared to alternatives. Also I recieved two validation codes. Have no idea why they were sent.
