What is the Missouri Warranty Deed

A warranty deed can be used in Missouri to convey title to real property. Missouri does not offer a statutory form for a warranty deed. In a duly executed warranty deed, the following covenants are generally included: covenant of seisin, power to sell, freedom from encumbrances, quiet enjoyment, and warranty of title. A warranty deed in Missouri will pass the after-acquired title of the grantor and will be effective as if the legal estate had been in the grantor's possession at the time of conveyance (442.430). The grantor in a warranty deed warrants the title against the acts of all others.

A warranty deed needs to be signed by the party granting the conveyance and should be acknowledged or proved and certified in the manner prescribed by Missouri Statutes. However, all parties are required to sign if the deed is being recorded in the City of St. Louis. For warranty deeds acknowledged or proved within Missouri, the proof or acknowledgement can be taken before a court having seal or a judge, justice or clerk of such court, or by a notary public. If the acknowledgment or proof of a warranty deed is taken outside of Missouri but within the United States, it can be done before any of the officers listed in 442.150 of the Missouri Statutes (442.150). The officer taking acknowledgements should have a certificate of acknowledgment or proof endorsed on the deed (442.180).

Every warranty deed that conveys real estate that has been proved or acknowledged and certified in the manner provided should be recorded in the office of the county recorder in the county where the real estate is located (442.380). Once a warranty deed has been filed for record, it will serve as notice to all persons of the contents thereof, and all subsequent purchasers and mortgagees are deemed, in law and equity, to purchase with notice (442.390).

Ease and speed of recording are remarkable. This is especially true of deeds with problems: I often get feedback within minutes and can correct problems immediately and still complete the filing in the same day. I wish more counties accepted electronic filing! It would be helpful to list counties that do/do not accept electronic filing so I would not have to upload documents to find out my effort was fruitless.

Worked well for me to create a deed for a house I inherited. It was very thorough and easy to use. I have no experience with the law so I just googled terms I didn't understand and was fine. I also called land records a lot and ended up not needing a lot of the material included, but it was still good to have it.

The service was prompt and attentive to my questions. I would've just appreciated a heads up that I also needed to contact the county directly (and provide contact info) to receive a certified copy of the document (Notice of Commencement) in order to submit the certified copy to the Building Department. This was an extra step that I haven't had to complete before using another eRecording service. Even if this extra step is a result of the county's system. I would still have expected a head's up (since there wasn't any info regarding this on the county's site for eRecording).

I needed a quitclaim deed to transfer ownership of a home. An attorney wanted $400.00 to file the deed. I downloaded a blank deed for my area from deeds.com. I received it instantly. (Small fee) it came with instructions and a template. I filled it out and submitted it to the County Clerks office.it was simple and I saved a lot of money. There may be other forms you need, check with whoever you are submitting the deed.
You'll have additional fees, but that is up to the municipality in which you reside. It will be helpful if you have the latest deed on file.
It was much easier than I thought. This is an easy website to navigate through and it is 100% legitimate. I recommend Deeds.com.
