Montana's Affidavit of Deceased Joint Tenant

The Montana Affidavit of Deceased Joint Tenant form is appropriate for use by a surviving joint tenant, as identified on a recorded real property deed.

Montana Code Annotated defines how joint tenancy is created at Section 70-20-105 and the associated right of survivorship at 70-20-310.

Under 72-16-503, to formally initiate the process of perfecting the title, the surviving owner should complete and record an affidavit containing those matters required by 7-4-2613(1)(c). Among other details, this document should identify the parties, the property, and the recording information. Also include an official copy of the deceased owner's death certificate.

Submit the affidavit and any other necessary paperwork to the clerk and recorder for each county in which the real property or any part of the property is located.

This is an important step because it contributes to a clear chain of title (ownership history), which should, in turn, make future sales of the property less complex. It also serves as public notice of the change in the property's status.

The Quitclaim deed seems pretty simple However I wonder if I can fll out the paper as easily as it looks I appreciate very much the sample and the direction for filling out the deed. Now I am in the process of gathering document to fill out the deed and I think only when after everything done, I may have a clear idea how good the Quitclaim Deed is. Very disappointed that you had certain documents but did not have the accompanying documents needed to complete the transfer. I also had issues with the documents not allowing you to fill in the pages... example the document was prefilled in as so ... Page 1 of_____ but you could not fill in the blank... I tried reaching out to your customer service, but they had no solution for me. So, I had to write in the page, which didn't look professional. I think I could have gotten documents just as good for free if I'd research a little longer.

The Virginia Transfer on Death Deed and the Virginia Transfer on Death Beneficiary Affidavit are separate documents and are offered individually because many customers only need one, depending on their situation. In your case, the affidavit was later ordered separately.

Regarding the page numbering (“Page 1 of ___”), that field is intentionally left blank. The total number of pages is not known until the document is finalized, signed, notarized, and all attachments (such as exhibits or legal descriptions) are included. It is standard practice to complete that portion by hand at execution so the final page count accurately reflects the recorded document.

The site is fine with one exception. About half the pdf files I downloaded were corrupted. I could not open them or view their contents. Fortunately, the link continued to work, so after I discovered this, I downloaded the corrupted files again, and they now seem fine. I do not know if my computer or the website caused this odd problem.

While it's nice to get all the forms and info in one package for a reasonable cost, the fixed format of the form does not allow for a lengthy meet and bounds property description for real property. Also, the Cover Sheet has big fillable sections with no instructions about what's supposed to go there. I tried the "Contact Us" link, but all it does is spin saying it's trying verify the security of my connection. Looks like I;m going to have to create my own deed in MS Word instead of just filling in the blacks of the PDF file that I downloaded. Bummer!

The Transfer on Death Deed form package was very good. But like anything, could use some improvements. There is not enough space to fill more than one beneficiary with any level of additional detail like "as his sole and separate property" The area for the legal description could be a bit bigger and potentially fit many legal descriptions. Or it could be made to simply say "See Exhibit A" as is likely necessary for most anyway. The guide should indicate what "homestead property" means so the user doesn't have to research the legal definition. (which turns out to be obvious, at least in my state, if you live there, it's your homestead.) It would be helpful if an "Affidavit of Death" form were included in the package for instances where the current deed hasn't been updated to reflect a widowed owner as the sole owner before recording with only the one signature.
