Owners Affidavit Regarding Liens in New Hampshire

Construction liens are governed by Chapter 447 of the New Hampshire Statutes.

In New Hampshire, property owners can use an affidavit containing details of all parties that have contracted with the owner to perform work on a project or job on the owner's property in excess of $1,000.00. The purpose of the document is to provide notice of all parties that have contracted with the owner but who may not have contracted with the general contractor.

The property owner should have personal knowledge and personally inspect the status and progress of work on the project. The owner should also review the general contractor's affidavit, if any, and the payment of any prior requisitions before making this certification. Be aware that affidavits are sworn statements, made under oath, and thus any false statement is subject to penalties for perjury.

The affidavit certifies: 1) that all work on the project or job and material supplied covered by the current requisition and prior disbursements has been completed or supplied as the case may be; and 2) that upon payment of the current requisition all subcontractors/materialmen covered by the current requisition will have been paid. It also includes copies of any associated contracts and/or notices. N.H. R.S.A. 447:12-A.

The affidavit also states that the Initial Notice of Construction Mortgage was posted at the job site pursuant to N.H. R.S.A. 447:12-b, I & III at the date and hour set forth therein and said Notice has remained posted and will continue to be posted there until the project/job has been completed. Lastly, the affidavit contains a covenant that the owner agrees to defend, indemnify and hold the recipient harmless from and against any and all liability arising in any way out of the falsity of the statements made above. I thought the forms were reasonably priced, the instructions included in the packet were thorough, and the examples helpful. Thank you for the additional CDR forms too. I contacted the Recorder's office via email with a question and Jennifer Bowser answered promptly. Job well done! However, when I delivered the deed and Real Property Transfer Declaration to the Clerk's office in Lafayette, the clerk was unfamiliar with the Declaration document being submitted and it took some time to convince her to submit the form without charging the recording fee. She even tried to phone the recorder's office for clarification, but no one answered. There then was an additional form at that office that I had to complete called Recording Request/Transmittal Form. I would suggest including that form with instructions in your on-line packet to speed up the process when a Deed is delivered to the County Clerk's satellite office. I do not expect every clerk to know all the particulars of recording requirements but a little knowledge wouldn't hurt.

I downloaded the Lady Bird deed. The process was quick and easy to download. Just select your county, fill out the form. You will need the property description from your original deed. In my case I had to go downtown Wayne County (Detroit). (Make an appt online). 1st you will have to get the property tax certified to ensure all taxes are paid to date (5th floor at the Wayne County Treasurer office). Give them the form you just filled out and they will stamp certified $5. After that take the form to the Register of Deeds (7th floor) appt needed. $18. Make sure it is properly notarized and all signatures completed. Once approved, they will scan it, stamp it, give it back with a receipt and mail a copy also. All Done. Worked beautifully. My co worker go a lawyer and paid over $250. I just used deeds.com and total for forms and going downtown with notarizing was less than $40 Yea!

The deed is great. However, I do not believe your Statement of Full Consideration is up to date as it does not give the reference for an exemption on the Transfer on Death Deed.
