A Deed of Trust assignment, also referred to as an "Assignment of Deed of Trust", occurs when the beneficiary/lender of the loan transfers their loan obligations to a third party. The lender will usually assign a Deed of Trust by selling it to a new bank or lender. This form can be used by the current beneficiary/lender even if the Deed of Trust in question states a different beneficiary/lender.
Current Borrowers must be notified of the assignment. Notification consists of contact information of the new creditor, recording dates, recording instrument numbers, changes in loan, etc. Included are "Notice of Assignment of Deed of Trust" forms.
The Truth and lending act requires that borrowers be notified when their Deed of Trust debt has been sold, transferred, or assigned to a new creditor. Generally, within 30 days to avoid up to $2,000.00 in statutory damages, plus reasonable attorney's fees. Systematic violations can reach up $500,000.00.

After some initial general confusion -- (we sold a small piece of land privately and therefore do not typically prepare such documentation (!)) -- we were able to purchase and download all forms from Deeds.com and understand how to complete it/them. The help is all there, we just needed to read and study it - the "Example" helped alot. We were able to complete the Document per your online form(s) and then take it to be signed/notarized - and take the completed paper document to the Registry -- and it is now all registered and we are All Set. rn Took the morning (only). Deed.com is AMAZING! I only had about 2 weeks to get my quit claim deed recorded by my county office before my refinace due date approached. When I uploaded my quit claim to Deed.com I got it electronically recored by county register's office in "24 hours"!!! Over all quality of document was good. The issue I had was where it states claimant did not have a contract with the owner or their agent. I did have a contract with their agent, and there was no option for both. So had improvise.
