Here are the laws, codes, and statutes that guide why a Release of Memorandum of Contract should be recorded in South Carolina:
1. Notice to Third Parties
South Carolina Code § 30-7-10 (Notice of real estate interests): This statute explains that recording certain documents (such as deeds or contracts) provides notice to third parties regarding property interests. Recording a Memorandum of Contract serves as notice that a binding agreement is in place regarding a particular property.
Once the underlying contract is fulfilled or terminated, a Release of Memorandum of Contract should be recorded to notify third parties that the previously recorded interest is no longer valid. 2. Cloud on Title

The State form I chose was valid and accurate. However, I found the ability to enter information was inadequate and difficult. Converted the form to a Word document and was then able to enter the information I needed to.

AMAZING! Easy to use, reasonable fee - and get MUCH MORE than just a deed form. I ordered a "deed" and received a whole "package," including a guide and the jurisdiction's costs schedule and cover page that would be needed to record the deed - even included a Certificate of Transfer that is not required for a deed but something I needed for a different transaction. The website was extremely easy to use and the cautions about not disclosing personal information were so clear and personal, they made me feel secure in knowing this site was not trying to rip me off. Forms easy to download but experienced problems trying to type in my information into the forms. Then when I went to print a form, Adobe wanted to charge me for printing. I ended up printing the blank forms and then filling them out manually.
