Under the South Dakota Codified Laws, the beneficiary of an interest in property may disclaim the gift, either in part or in full (SDCL 29A-2-801). Note that the option to disclaim is only available to beneficiaries who have not acted in any way to indicate acceptance or ownership of the interest (29A-2-801).
The disclaimer must be in writing and be filed within nine months of the transfer (e.g., the death of the creator of the interest) with the clerk of the court in which the estate is or was pending (29A-2-801 (b)). If real property is involved, record a copy of the document in the office of the Register of Deeds of the county in which the property is located in order to avoid any ambiguity regarding the chain of title.
A disclaimer is irrevocable and binding for the disclaimant and his or her creditors, so be sure to consult an attorney when in doubt about the drawbacks and benefits. If the interest arises out of jointly-owned property, seek legal advice as well.

Customer service was poor. I felt like I had to debate the representative to provide guidance and assistance. They acted as though I knew the process, the documents involved, etc. At the same time, they asked me to confirm which documents or at least pages needed to be filed. Best Way EVER to record a warranty deed! It was nice to not have to drive anywhere and find the facility closed or "unable to process due to covid19 and buildings being closed". The correspondence between me and deeds.com was very timely in our back and forth email correspondence, and the processing was all finished in a timely manner. Totally worth the extra $15 that I paid in addition to the recording fee. I would use this again and again. My time and the efficiency of the job completed is worth the money.

Guidelines somewhat helpful. Forms fillable but not editable unless you buy an Adobe conversion service subscription. End product looks crude and amateurish. Fields can't be reduced or enlarged to accommodate unique data. Very disappointing.

recently joined Deeds.com. still exploring the site. has been very helpful in providing local information for recording, such as fees and requirements. i am working to correct mistakes made within a deed. it is amazing how these municipalities operate outside the scope of Article 1, Section 8, Clause 17; to claim land is "in" the "State of ____. when the land is actually not ceded to the United States of America as for use for needful buildings. beware of the fraud perpetrated by Attorneys in the recording of your Deeds. Registration as "RESIDENTIAL" puts your private-use land on the TAX rolls with the use of that one word. i recommend this site as it appears there is information for each state and each county office. will update my review once i place an order.
