A durable power of attorney designates in writing an agent (attorney in fact) and contains the words. (This power of attorney shall not be affected by subsequent disability or incapacity of the principal, or This power of attorney shall become effective upon the disability or incapacity of the principal, or similar words showing the intent of the principal that the authority conferred shall be exercisable, notwithstanding the principal's subsequent disability or incapacity.) (34-6-102.)
This instrument offers three choices for effective dates.
1. Immediately
2. Upon incapacity
3. Immediately when my spouse is acting as my Agent. If my spouse declines, is unable or ceases to serve as Agent, this Power of Attorney becomes effective upon my becoming disabled or incapacitated.
In the event your agent is unable or unwilling to serve a (substitute Agent) is named.
When the principal is (disabled or incapacitated). All acts done by the agent (attorney in fact) (bind the principal and the principal's successor in interest as if the principal were competent and not disabled.) 34-6-103
In general, if the attorney if fact acts under the power of attorney, he/she has a duty to account to the principal, or any legal representative. 34-6-107
This Durable Power of Attorney states: Pursuant to T.C.A. 34-6-101 et seq. and T.C.A. 34-6-201 et seq. (collectively the "Law"). I intend for the Law to apply in all respect and for this instrument to be construed broadly and not narrowly.

I found this site a must. It provided all the forms I needed to file a Quit Claim Deed. I filed what use to be called a Quick Claim Deed 30 years ago. You only had to file the one form. Today it is called a Quit Claim Deed. The pack provided forms that I had no idea had to be filed with the Quit Claim Deed. I would not have known this otherwise if the option hadn't presented itself. Your Personal Representative's Deed and example for the state of PA were extremely helpful. Exactly what I needed! Two feedback comments: 1. Valuation Factors/Short List in my download is an outdated table dated July 2020. The PA Dept of Revenue website has a more current table dated June 2021. (Maybe same for Valuation Factors/Long List, which I didn't use.) 2. Notarization section on deed page 3 has a gender-related input needed, which confused the Notary Public representative where I live in the state of CO. Notary input the word she to apply to my wife, but wasn't clear to him if the gender input applied to the Grantor or the Notary. He assumed Grantor. Also in our non-binary world, some might find that wording offensive. Thanks again for your documents. Russ Lewis

This is an initial review of Deeds.Com and the ordering process for their Quit Claim package for Virginia. The ordering process was very easy and the price seems reasonable for what you get. I have reviewed and downloaded all my forms, but have not used them yet. Thus far I am pleased with the product and the process. This is not at all the form that I needed. I am trying to disclaim my interest in a property, but this form is much too rigid to work for my case. It would have been nice to know some of the more specific details before purchasing the document.
