A durable power of attorney designates in writing an agent (attorney in fact) and contains the words. (This power of attorney shall not be affected by subsequent disability or incapacity of the principal, or This power of attorney shall become effective upon the disability or incapacity of the principal, or similar words showing the intent of the principal that the authority conferred shall be exercisable, notwithstanding the principal's subsequent disability or incapacity.) (34-6-102.)
This instrument offers three choices for effective dates.
1. Immediately
2. Upon incapacity
3. Immediately when my spouse is acting as my Agent. If my spouse declines, is unable or ceases to serve as Agent, this Power of Attorney becomes effective upon my becoming disabled or incapacitated.
In the event your agent is unable or unwilling to serve a (substitute Agent) is named.
When the principal is (disabled or incapacitated). All acts done by the agent (attorney in fact) (bind the principal and the principal's successor in interest as if the principal were competent and not disabled.) 34-6-103
In general, if the attorney if fact acts under the power of attorney, he/she has a duty to account to the principal, or any legal representative. 34-6-107
This Durable Power of Attorney states: Pursuant to T.C.A. 34-6-101 et seq. and T.C.A. 34-6-201 et seq. (collectively the "Law"). I intend for the Law to apply in all respect and for this instrument to be construed broadly and not narrowly.

Very easy process for both quit claim and beneficiary deed forms and explanations.. also gives an example form filled out to ensure you have something to go by when filling out your own for accuracy.. the forms are for your specific county, city, and state so no problems when you go to record at deeds office!

The paperwork/forms are fine, but there isn't enough explanation for me to figure out how to file the extra forms (which I do need in my case). The main form, Deed Upon Death is fine. I think the price is pretty high for these forms. I wouldn't have purchased it because there are places to get them for much cheaper (about 6 dollars), but this site had the extra forms I wanted (property in a trust and another form). Unfortunately these were included as a "courtesy" and there are no instructions for them. So three stars for being clear about what was in the package, having the right forms that I need, but instructions for putting them to use and price took a couple of stars off. Downloading was easy and once you download you can type the info into the PDF--that makes working with the forms much easier.
Thank you for the feedback Maria. Regarding the supplement documents, it is best to get assistance from the agency that requires them. These are not legal documents, they should provide full support and guidance for them.

1) I was very pleased when the staff mentioned your service since the three referenced on the Recorder's website all wanted HUGE Account set-up and maintenance fees AND BIG fees per recording, and yours has no set-up fee AND nominal per-recording fee; 2) My (few) recordings will be NON-LAND Related, summary or entire record(s) of Administrative (Procedures Act) records, Other than the Border width and Cover Sheet, do you anticipate any other special requirements for such recording(s)? NOTE: I just sent one by Snail Mail, and they just informed me that due to the GERMIPHOBIA 'Pandemic' the ONLY open and record Snail Mail ONCE A MONTH On the first of each chmonth!

The form is so limited in space that I can not fit the vesting information as well as the real property information. The property information, I could put it as Exhibit A. which is not the usual way. Not happy.
