A certification of trust is a document that contains relevant details about an established trust containing real property. It is governed by Texas Property Code Sec. 114.086. A certification of trust validates the existence of the trust by identifying its full name, the date it was established, the names of the settlor (grantor) and trustees, the trustees' powers, and other details as needed. This is important because it allows the actual trust agreement, which is generally not recorded, to remain private.
The form is executed by the trustee and signed by the trustee and grantor (who can be the same person) and recorded in the office of the county recorder in any Texas county in which all or a portion of the real property is located. In order to facilitate a transfer of real property into a trust, financial institutions may require the trustee to furnish a certification of trust. In addition, third parties may request a certification of trust to confirm the trustee has the authority to transfer real property out of the trust.

Deed.com is an amazing site. After calling many places and going on many websites to figure out what I needed to submit (most counties cannot help with questions and the place I needed to turn the documents into could not help either, they are not allowed to give legal advice) I came across Deeds.com. I can't believe I haven't been using this service since inception. The only thing I would recommend is to allow us to delete an erroneous upload. I accidentally uploaded the same document twice but I saw no way for me to correct my mistake other than to send an email.

The Quitclaim deed form was fine. Unfortunately, all I wanted to accomplish was to transfer property held in my name into my trust, but I could not any wording on the information you provided on how to accomplish this. It was not a sale, just a transfer from me to me as trustee.

I thought the instructions could have been a little better. I didn't know how to do this if the spouses are married but living in separate residences. Also I didn't understand the "Prior Instrument Reference". That should be explained better. Very sketchy instructions.

Good so far could use more examples for each section of info. needed. ex. (parcel and alt.ID info where to find and etc. #2 more examples. If it was not for the red print examples helping to fill the form out I could have downloaded free forms, the examples are what made me choose your form !
