This form is executed/signed by the borrower/Assignor as inducement for the Lender/Assignee to make the loan evidenced by a Note secured by a Deed of Trust, borrower/Assignor has agreed to an assignment of rents in accordance with Chapter 64 of the Texas Property Code to Lender/Assignee in, to and under any and all leases (hereinafter collectively referred to as the "Leases" and singularly as a "Lease") and any rights to receive payments and liens securing rights to receive payments under notes, contracts for deed or otherwise arising (hereinafter collectively called "Notes and Liens")
Sec. 64.053. ENFORCEMENT OF SECURITY INTEREST IN RENTS GENERALLY.
(a) An assignee may enforce an assignment of rents using one or more of the methods provided by Section 64.054 or 64.055 or any other method sufficient to enforce an assignment of rents under a law of this state other than this chapter.
(b) On and after the date on which an assignee begins to enforce an assignment of rents, the assignee is entitled to collect all rents that:
(1) have accrued but remain unpaid on that date; and
(2) accrue on or after that date.

I was in a rush to record a quit claim deed, however due to covid 19 Miami dade county recorders office are not open to public. According to staff I would have to mail in the quit claim deed and wait approximately two weeks for the deed to get recorded. Thanks to Deeds.com I got my document recorded in less than one day. Ultimately, it directed me to the wrong form. Not very helpful. I had to turn to a title company to get my issue addressed.

The experience was generally very satisfactory. I was able to fill out the Trust Deed and send it via email no problem. However, I was not able to send the filled out form of the Note. It always erased my fill-ins when it was sent. I found that very frustrating.
Thank you, Gordon. Glad the Trust Deed worked well. Issues like the one you reported with the Note can sometimes be related to how the file is opened or sent. Using Adobe Reader to fill, save, and send the form is recommended. We also pass along all feedback like this to our team to confirm there are no issues.
