A deed of trust (DOT) is a document that conveys title to real property to a trustee as security for a loan until the grantor (borrower) repays the lender according to terms defined in a promissory note. It's similar to a mortgage but differs - mortgages only include two parties (borrower and lender). In Texas a Deed of Trust is the preferred lending instrument.

There are three parties to a deed of trust: the borrower (grantor), the lender (beneficiary), and the trustee. The trustee, typically a title agency or other disinterested party, serves two purposes: to initiate the foreclosure process for the lender if the borrower defaults on the loan, and to transfer (reconvey) the property back to the borrower after the debt is paid in full.

This DOT includes a power of sale clause, this can be beneficial to the lender, saving time and expense in the case of a foreclosure. Sec.51.0074. DUTIES OF TRUSTEE.
(a) One or more persons may be authorized to exercise the power of sale under a security instrument.
(b) A trustee may not be:
(1) assigned a duty under a security instrument other than to exercise the power of sale in accordance with the terms of the security instrument; or
(2) held to the obligations of a fiduciary of the mortgagor or mortgagee.

This is the first time that I have used this service. An employee at the Clerk and Register office in Arizona suggested that I try Deeds.com to find the form I needed and the county office could not provide. I am a licensed Realtor in Colorado with a 43-year career and this service has not been necessary in my own state but it was extremely helpful in finding a form in Arizona. I have one suggestion and couple of question I would think that most TOD's would be from married couples. It would be real helpful to have a example of the I(we) block for married couples. Why would I check or not check the "property is registered (torrents)" Do I need a notarized signature of the Grantee

Not user friendly, and not an Adobe fan. The first page of Quitclaim Deed form cuts off the Parcel Identification line on the bottom. Also quite a few forms showed up to be downloaded , after I paid, so I was unsure if all the forms were part of the quitclaim package. I have adobe but was unable to locate the forms in adobe on my computer after I downloaded them. Just wanted to print out one quitclaim deed form, which would have taken less that 3 minutes. instead it took 97 minutes. Thank you, though, for having the form there.
