Texas homestead law turns away almost every lien, but owelty of partition stands on the short constitutional list of debts a homestead can secure. When co-owned property passes to one owner, whether a divorce court awards the family home to one spouse or heirs agree that one of them keeps an inherited house, the equalizing debt owed to the departing owner can be secured against the entire property under Article XVI, Section 50(a)(3) of the Texas Constitution. The real estate lien note is the instrument that puts that debt on paper: the written promise to pay that the owelty lien secures.
A Debt the Homestead Can Secure
The constitutional text is specific. The owelty must be imposed against the entirety of the property, not just a fractional share, and it must come from a court order or a written agreement of the parties to the partition; the provision expressly includes a debt of one spouse in favor of the other spouse resulting from a division or an award of a family homestead in a divorce proceeding. Property Code Section 41.001(b)(4) carries the same rule in the statutes. Because owelty is its own constitutional category, a buyout documented this way travels a different path from a home equity loan under Section 50(a)(6), and refinance lenders routinely treat a recorded owelty lien as a debt eligible for rate-and-term refinancing.
One Buyout, Three Instruments
Texas owelty practice divides the work among three documents. A deed conveys the departing owner's interest and carries the owelty lien. A deed of trust secures repayment against the property with a power of sale. And this note states the money terms: the principal amount fixed by the decree or partition agreement, the interest rate, the rate on matured unpaid amounts, and the terms of payment, with recitals tying the debt to the decree or agreement and to the deed of trust. The note is signed by the maker alone, without a notary, and it is never recorded; the deed and deed of trust go to the county clerk, while the original note is delivered to the payee, who holds it until the debt is paid and then signs a recordable release of lien.
The Money Terms
The Finance Code frames the interest entries. An agreed rate operates under Chapter 302 and the optional ceilings of Chapter 303; where no interest is agreed, Section 302.002 supplies legal interest of 6 percent beginning on the 30th day after an amount is due. The note's printed terms include a usury savings clause that caps every rate at the lawful maximum, prepayment in whole or in part at any time without penalty, acceleration on an uncured default, and a collection-costs provision alongside the attorney's fees recovery that Civil Practice and Remedies Code Section 38.001 extends to written contracts. The terms of payment stay in the parties' hands: a single maturity date, monthly installments, or payment due on sale or refinance of the property all appear in owelty practice.

Highly Pleased- Strongly Recommend Deeds.com Long review... sorry:-) Originally I was very skeptical due to the enormous amount of the scams going on now days and the number of online sources that "claim" to provide you with deed forms for free or for a few. Nothing that you need and want done is free. There is always a cost. So luckily I came across deeds.com. This was the only site that appeared to be simple, to the point, and made no crazy promises. So before selecting this site, I did a little more checking around/price checking to ensure I am getting the best price for the product I needed. I even checked Staples and Amazon to find that they do indeed sell these forms but I do not think the products they provide are specific for my state and county. They claim their forms provided are for all states but my state is specific and I prefer to have forms provided by Deeds.com that is based on Indiana statute that Deed.com clearly identifies on each form. Deeds.com price of $20 seemed a little high at first but when I saw the products provided, the $20 cost is more than reasonable and fair. You not only get the deed form specific for my state and my specific "county" but also the other various/supplemental forms that may be required. Being familiar with my state and knowing how tedious and anal my state is on everything, I was pleasantly please to see the info and extra supplemental forms provided. For example, a person new to the State who recently had property deeded to them, would not necessarily know about the Homestead tax exemption provided if property is your primary residents, over 65 exemption etc. I would highly recommend this site for anyone needing these documents because Deeds.com has you covered on any and all forms/info you could ever need! A bonus is that there is one flat fee and not monthly cost that you have to worry about canceling later unless you superficially select a monthly package. I love the fact that Deeds.com is nothing fancy. There is not a bunch of elaborate graphics etc. They only provide what you need and what they provide is very accurate. Deeds.com has a customer for life.

I am delighted with the form. I just had to go through so much time and expense in order to use it. First, from your site I downloaded Adobe Acrobat. It totally compromised my computer. I had to get a computer expert to walk me through deleting adobe, and put a substitute on in order to use the form. That was an expense of $60.00. Then after that I still had a hard time getting the program to work, as the substitute program would not accept my e-mail address and I finally had to get someone on line to help me access that. I found it was a $$30.00 charge for the substitute. After fighting these lovely roadblocks, I was finally able to fill in the only form I needed and print it off. Took me two days to accomplish that. Why on earth do you offer adobe when it can compromise a computer so badly? Dealing with my husbands death and then having to deal with this, just one of many deterrents, well let's put it this way, it did not make my two days.

The Quitclaim deed form was fine. Unfortunately, all I wanted to accomplish was to transfer property held in my name into my trust, but I could not any wording on the information you provided on how to accomplish this. It was not a sale, just a transfer from me to me as trustee.

Please change on the example for the warranty deed the portion that says Source of Title: They don't use book and pages anymore They only use recording numbers. Please show an example with that for Maricopa County AZ Plus your Notary certificates should have a blank part for if it is signed in another state.

The "Trustee's Deed" should have been labeled a Deed of Trust because that's what it really is. So now I just wasted $19.97 getting something I can't use.
