A community property survivorship agreement is not permanent. Spouses whose plans change can end the arrangement, returning the property to plain community property, where each spouse's interest passes by will or intestacy rather than automatically to the survivor. This form prepares the written revocation Section 112.054 of the Texas Estates Code describes.
Two Statutory Paths
Where the agreement itself states a revocation method, that method controls. Where it does not, Section 112.054 supplies two: a written instrument signed by both spouses, or a written instrument signed by one spouse and delivered to the other. The form accommodates both. When both spouses join, both sign and the delivery line is marked not applicable, as the completed example shows. When one spouse acts alone, that spouse signs and the form records the date the written revocation was delivered to the other spouse.
Why the Revocation Belongs in the County Records
Recording matters most where the original agreement was recorded. The Estates Code protects a purchaser who deals with the surviving spouse without notice that the agreement was revoked, so a revocation kept off the record leaves the county records telling an outdated story, with real consequences for who takes good title. Recording the revocation in the same county as the agreement keeps the record aligned with the spouses' actual arrangement. The form carries notary certificates so it is ready for recording.
What the Form Asks For
The revocation identifies both spouses, the agreement being revoked by its date and recording reference, and the property by county and formal legal description, matching the original instruments. The guide shows where each entry comes from, and the completed example documents a finished revocation of a recorded agreement.

I thought the forms were reasonably priced, the instructions included in the packet were thorough, and the examples helpful. Thank you for the additional CDR forms too. I contacted the Recorder's office via email with a question and Jennifer Bowser answered promptly. Job well done! However, when I delivered the deed and Real Property Transfer Declaration to the Clerk's office in Lafayette, the clerk was unfamiliar with the Declaration document being submitted and it took some time to convince her to submit the form without charging the recording fee. She even tried to phone the recorder's office for clarification, but no one answered. There then was an additional form at that office that I had to complete called Recording Request/Transmittal Form. I would suggest including that form with instructions in your on-line packet to speed up the process when a Deed is delivered to the County Clerk's satellite office. I do not expect every clerk to know all the particulars of recording requirements but a little knowledge wouldn't hurt.

Highly Pleased- Strongly Recommend Deeds.com Long review... sorry:-) Originally I was very skeptical due to the enormous amount of the scams going on now days and the number of online sources that "claim" to provide you with deed forms for free or for a few. Nothing that you need and want done is free. There is always a cost. So luckily I came across deeds.com. This was the only site that appeared to be simple, to the point, and made no crazy promises. So before selecting this site, I did a little more checking around/price checking to ensure I am getting the best price for the product I needed. I even checked Staples and Amazon to find that they do indeed sell these forms but I do not think the products they provide are specific for my state and county. They claim their forms provided are for all states but my state is specific and I prefer to have forms provided by Deeds.com that is based on Indiana statute that Deed.com clearly identifies on each form. Deeds.com price of $20 seemed a little high at first but when I saw the products provided, the $20 cost is more than reasonable and fair. You not only get the deed form specific for my state and my specific "county" but also the other various/supplemental forms that may be required. Being familiar with my state and knowing how tedious and anal my state is on everything, I was pleasantly please to see the info and extra supplemental forms provided. For example, a person new to the State who recently had property deeded to them, would not necessarily know about the Homestead tax exemption provided if property is your primary residents, over 65 exemption etc. I would highly recommend this site for anyone needing these documents because Deeds.com has you covered on any and all forms/info you could ever need! A bonus is that there is one flat fee and not monthly cost that you have to worry about canceling later unless you superficially select a monthly package. I love the fact that Deeds.com is nothing fancy. There is not a bunch of elaborate graphics etc. They only provide what you need and what they provide is very accurate. Deeds.com has a customer for life.
