A special warranty deed can be used in Texas to convey title to real property. Special warranty deeds in this state will contain both express and implied warranties. A special warranty deed in Texas only warrants against defects, liens, and encumbrances arising by, through, or under the grantor. Even if a conveyance does not have express covenants of warranty, the words "grant" and "convey" will imply only the following covenants from the grantor: (a) That prior to the execution of the conveyance, the grantor has not conveyed the estate or any interest in the estate to any person other than the grantee and (b) that at the time of execution of the conveyance, the estate is free from any encumbrances (5.023).
A real property instrument, such as a special warranty deed can be recorded if it has been acknowledged, sworn to with a proper jurat, or proved according to law (12.001). Original signatures are required. The failure of a notary public to attach an official seal to an acknowledgment or other proof taken in a state other than Texas will render the acknowledgment invalid only if the jurisdiction in which the acknowledgement is taken requires the notary public to attach a seal (12.001d).To be effectively recorded, an instrument relating to real property must be eligible for recording and must be recorded in the county where the property, or a part of the property, is located (11.001).
Recording an instrument is necessary to provide constructive notice. When a special warranty deed has been properly recorded in the county where the property is located, the instrument is deemed to impart constructive notice of the contents to all persons. Additionally, the instrument will be part of the public records and is open to inspection (Sec. 13.002). A special warranty deed will be void as to a creditor or subsequent purchaser for a valuable consideration without notice unless the deed has been acknowledged, sworn to, or proved and filed for record (Sec. 13.001). Unrecorded special warranty deeds are binding on the parties to the instrument, on the parties' heirs, and on a subsequent purchaser who does not pay a valuable consideration or who has notice of the instrument (Sec. 13.001c).

The documents themselves are fine and the information provided with them is helpful. I find the actual processing of the documents, however, to be difficult particularly once the document has been saved. First, I note that the box for the date only allows entry of the last 2 digits of the year. Unfortunately, my download only allows me to enter one of the 2 digits required. When I delete it repeatedly, it eventually allows both digits to be entered but puts them in extremely small text and in superscrypt. I have not found a solution to this problem and am not sure the deed can even be recorded with this problem. Another problem is that if you try to revise the document after you have saved it the curser goes to the end of the line after each key entry. This means that there basically is no way to efficiently save the document for reworking later since you will have to delete everything you have entered in the text box unless you only need to make a single keystroke change or are willing to replace the curser after each entry. Try that with a long property description! Please note that I am using a Mac to prepare my documents and perhaps this is part of an "incompatibility problem". However, I didn't see a disclaimer regarding Mac use and so would expect the documents to perform correctly. Overall, I give the program a "2 star" rating because I am experiencing significant difficulties in entering dates in the documents even before saving them and because saving your work for later revision appears to be basically unworkable.

EZ to use program....was able to print all forms ordered. I expect to go back to to use recording ability. Instructions are easily followed...would be nice to have confirmation included but they are available to purchase. Hope for successful recording of TOD affidavit. Pretty good value...attorney quoted well over the price I paid for package.

Deeds.com was such a blessing in order for me to get something done that my lawyers could not get done. Transferring a mineral right from my deceased parents to me and my husband. The mineral company person I worked with went above and beyond helping me fill the paperwork out perfectly so that it had “right of survivorship” (and other things phrased properly) so that either my husband or I won’t have the issue I have had.
