The majority of Texas foreclosures are non-judicial. They require a trustee's deed (alternately called a foreclosure deed or substitute trustee's deed, if applicable) to convey foreclosed property at a trustee's sale.

Trustee's deeds identify three primary parties: the grantor, who is the trustee in the deed of trust; the beneficiary, who is the lender and grantor in the deed of trust; and the buyer, who is the grantee and purchaser of the property at the foreclosure sale.

In a deed of trust, a trustee (the grantee under the original deed of trust instrument), appointed by the lender, holds the deed to the property as collateral for a loan to be repaid by the borrower (the trustor under the deed of trust). If the borrower fails to fulfill the terms of the deed of trust, the lender can direct the trustee to enforce the terms of the deed or begin the foreclosure process. This starts with a notice mailed to the borrower, now debtor, of the intent to accelerate. Notice of sale is also recorded and posted in the county where the subject property is located, as directed by Tex. Prop. Code 51.002 et seq.

A trustee's deed may sometimes be called a substitute trustee's deed, but it is functionally the same thing. The lender may appoint a substitute trustee if the original trustee is unable to administer the sale of property at public auction. A substitute trustee is a person named by the lender under the terms of the security instrument (deed of trust) to exercise the power of sale (Tex. Prop. Code 51.0001(7)). The power to appoint a substitute trustee must be expressly designated by the lender in the deed of trust, otherwise the appointment is invalid. A substitute trustee can be appointed at any time during the foreclosure process, so long as notice of the appointment is recorded. The foreclosing trustee, regardless, is generally an attorney for the lender. The trustee should identify in the deed whether they are serving as a trustee or substitute.

Ease and speed of recording are remarkable. This is especially true of deeds with problems: I often get feedback within minutes and can correct problems immediately and still complete the filing in the same day. I wish more counties accepted electronic filing! It would be helpful to list counties that do/do not accept electronic filing so I would not have to upload documents to find out my effort was fruitless.

The forms worked well for entering information. I have finished without much trouble. Since the forms are Adobe PDF files you need the free app to use them but you can't edit unless you have the paid Adobe program. And, it was a reasonable price.

Please change on the example for the warranty deed the portion that says Source of Title: They don't use book and pages anymore They only use recording numbers. Please show an example with that for Maricopa County AZ Plus your Notary certificates should have a blank part for if it is signed in another state.

Pros, quick purchase and document availability including instructions and examples. Cons, For the cert. of trust, the form would not accept the length of our trust name with no way to get around. The pdf file printing did not meet the requirements for 2.5" top margin and .5" other margins as well as the 10pt font size as the form information was shrunk down even when normal printing.

First time using Deeds.com and feel that your platform is clear and easy to use. I was also pleased with the messaging center and follow-up and also surprised at how quickly our particular deed was recorded and available to view. Having said that, when I first investigated Deeds.com the fee was $15 and as of 1/1/21 it has increased to $19 which I feel is pretty steep for the handling of 1 simple document especially when the turnaround was basically the same day. Your fee was nearly the equivalent of the cost of the Clerk's recording fee. Perhaps you should offer a fee schedule for those of us who are not volume recorders. Just a thought.
