Utah Affidavit of Survivorship: Clearing Title After a Joint Owner's Death

Utah's affidavit of survivorship, also called an affidavit of surviving joint tenant, is governed by Section 57-1-5.1 of the Utah Code. It is used after one owner of jointly held property dies, to update the public record and confirm the surviving owner's title.

How Survivorship Transfers Title in Utah

When property is held in joint tenancy, each owner has a right of survivorship. The deceased owner's interest terminates automatically upon death and passes to the surviving owner or owners by operation of law, without probate. Recording this affidavit discloses that termination in the public record, confirming the survivor's ownership and removing the deceased owner from the chain of title.

What Utah Code § 57-1-5.1 Requires

Under Section 57-1-5.1, the affidavit must cite the interest being terminated; contain a legal description of the property; refer to the recording information of the deed that created the interest; include a copy of the deceased owner's death certificate, or other qualifying government-issued proof of death, attached as an exhibit; and be recorded in the recorder's office for the county where the property is located.

I was trying to register a financial statement (non real estate document). There was no link or statement on the home page to indicate that this could be done. All I had to do was to create an account, name and then upload the document. It took me over a day and several phone calls to the local deed recording office to try to figure this out. A simple link or statement to this effect would have saved me a lot of time

I found this site a must. It provided all the forms I needed to file a Quit Claim Deed. I filed what use to be called a Quick Claim Deed 30 years ago. You only had to file the one form. Today it is called a Quit Claim Deed. The pack provided forms that I had no idea had to be filed with the Quit Claim Deed. I would not have known this otherwise if the option hadn't presented itself.
