The memorandum of trust, codified under the Estates and Trusts chapter of the West Virginia Code at 36-1-4a is executed jointly by all acting trustees and living settlors of a trust. It is recorded in the land records with an acquisition and/or conveyance of real property by a trust in order to maintain a clear account for potential title examinations.
A memorandum contains a statement that the trust exists and the date of the trust; the names of each settlor, current trustee, and successor trustee; the conditions under which the successor assumes trustee powers; and whether or not the trust is revocable. The form also requires a verbatim accounting of the trustee's powers "relative to the acquisition, sale, disposition, or encumbering of real property ... or the conveyance or disposition of real property," depending on the situation, and any restrictions on those powers (W. Va. Code 36-1-4a(a)(2)(iv)). Due to the nature of the transaction for which the memorandum is recorded, a legal description of the subject property is also required. The memorandum may also include the entire text "of any or all of the provisions of the trust" ( 36-1-4a(b)).

Over all quality of document was good. The issue I had was where it states claimant did not have a contract with the owner or their agent. I did have a contract with their agent, and there was no option for both. So had improvise.

Communication is hard. The reps need to be empowered and encouraged to call the customers when necessary. They encourage 300 dpi resolution and under 2 MB PDF file, which is not even possible with our scanner. They made a vague comment about a legal description looking abbreviated but did not explain. They refused to call me. They said the county said "Image is light please darken", but the image looked fine to me. Maybe not their fault, but they refused to help work with the county on that for me. I followed their suggestion though and re-scanned at 300 dpi, but they misunderstood me and did not re-submit it right away. Over 48 hours later, it's still not recorded yet. I hope it will be today.

The Lady Bird Deed appears to be fine with me as are the instructions. However, there apparently are no specific laws in Texas addressing them other than they are OK. The problem is that lenders are surely going to use them as triggers for their due on sale clauses, especially as the current small mortgage rates begin to increase. The solution to that seems to be to sign and have them notarized, but not to record them unless the holder needs to enforce the provisions. It seems to me that you should consider your solution to that problem in your instructions.

After some initial general confusion -- (we sold a small piece of land privately and therefore do not typically prepare such documentation (!)) -- we were able to purchase and download all forms from Deeds.com and understand how to complete it/them. The help is all there, we just needed to read and study it - the "Example" helped alot. We were able to complete the Document per your online form(s) and then take it to be signed/notarized - and take the completed paper document to the Registry -- and it is now all registered and we are All Set. rn Took the morning (only).
