The memorandum of trust, codified under the Estates and Trusts chapter of the West Virginia Code at 36-1-4a is executed jointly by all acting trustees and living settlors of a trust. It is recorded in the land records with an acquisition and/or conveyance of real property by a trust in order to maintain a clear account for potential title examinations.
A memorandum contains a statement that the trust exists and the date of the trust; the names of each settlor, current trustee, and successor trustee; the conditions under which the successor assumes trustee powers; and whether or not the trust is revocable. The form also requires a verbatim accounting of the trustee's powers "relative to the acquisition, sale, disposition, or encumbering of real property ... or the conveyance or disposition of real property," depending on the situation, and any restrictions on those powers (W. Va. Code 36-1-4a(a)(2)(iv)). Due to the nature of the transaction for which the memorandum is recorded, a legal description of the subject property is also required. The memorandum may also include the entire text "of any or all of the provisions of the trust" ( 36-1-4a(b)).
Each case is unique, so contact an attorney with questions about this form or anything else relating to trusts in West Virginia.

Review: Straightforward and pretty easy to use. The only downside is that there is no way to contact them directly. The number on the website is answered only by a voicemail with no return calls. Pricing seems fair compared to other services and much more efficient that filing "over the counter."

Review: This is a very useful site for downloading legal forms - just be sure you're getting the form you need before buying. Unfortunately I selected the wrong form initially and had to buy a 2nd form to correct my error. I saw no way of communicating my error at that point - i.e., loss of one star.

Review: I tried to use the free stuff you find on the internet. You quickly find out that free is rarely ever (never) free. Even worse, the long term cost can be immeasurable. Glad I realized that before I got too far in. Do yourself a favor, spend a few bucks up front to get the right forms.

Review: Sorry, I did not see that I was in the wrong review and just sent a review of a "product" I ordered online. As for Deeds.com I was very happy with the process and speed of getting the forms. I have used this site before. Highly recommend.

Review: It would be helpful to be able to edit verbiage on the form. I was preparing a Deed of Distribution; therefore, there was no consideration paid. I had to type the language into a Word document instead.
