Removing a Deceased Joint Tenant from a Wisconsin Real Estate Deed
Wisconsin laws provide that two or more people may hold real estate as joint tenants with right of survivorship. If one joint tenant dies, his/her share of the property is distributed evenly amongst the remaining co-owners without the need to pass through probate.
To terminate the decedent's interest in the property and to complete the distribution, file a form HT-110 under Wis. Stat. 867.045, with the register of deeds for the county where the property is located.
Recording the form formalizes the transfer of property rights, but the deceased joint tenant's name will still appear on the deed. Complete and record an updated deed from all joint tenants, but identify the deceased co-owner, and convey the property to the survivors only. It might be necessary to provide copies of the original deed, the death certificate, and the recorded HT-110 when submitted the revised deed.

We aimed to handle a survivorship affidavit (deed change) without a lawyer following my dad's death. After some searching, deeds.com seemed to have the most comprehensive and "correct looking" form we could find for our locale, so we went with it, and it was accepted by our recorder's office. I'm not sure why our local government office doesn't offer a standard form, but they don't, and deeds.com came through for us in a pinch.
We appreciate your business and value your feedback. Thank you. Have a wonderful day!

Excellent service, great feedback and recommendations by the deed preparer, and I really appreciate the personalized service. The website is amazing, everything is well thought out, and all messages are saved, clear and easy to read. I wish my website was so easy to navigate! Seriously, the person who worked on my account is awesome. They made recommendations about what to include and what not to include. They didn't make me feel dumb for asking questions about out-of-state service and filing procedures, and I will be using Deeds.com exclusively on my cases. Five stars !
We appreciate your business and value your feedback. Thank you. Have a wonderful day!

Could not have been easier. Instructions were clear. Guidelines and example were clearly written. Erecording worked fast and let me skip a dreaded trip downtown to be ignored by government employees who hate their jobs.
