StatewideThe documentary fee is payable to and collected by the county clerk and recorder, in addition to any other recording fee. No documentary fee is payable when there is no consideration or the total consideration is five hundred dollars or less. When real property in two or more counties is conveyed in a single transaction, each clerk collects a portion of the fee in proportion to the consideration attributable to the property in that county. (C.R.S. 39-13-102)
If no documentary fee is declared, the document may be returned. Where no money changed hands or the amount was less than $500, the office asks that this be stated on the face of the deed or in a cover letter.
