Transfer tax
Documentary stamp tax on deeds. On each $100 of the consideration therefor the tax shall be 70 cents. The tax is collected when the document is recorded. (statewide, Fla. Stat. § 201.02(1)(a))
StatewideDocumentary stamp tax on mortgages, trust deeds, security agreements, or other evidences of indebtedness filed or recorded in Florida: 35 cents on each $100 or fraction thereof of the indebtedness or obligation evidenced (Fla. Stat. § 201.08(1)(b)). Nonrecurring intangible tax: 2 mills on each dollar of the just valuation of notes, bonds, and other obligations secured by mortgage, deed of trust, or other lien upon Florida real property (Fla. Stat. § 199.133). A county as defined by s. 125.011(1) may levy a discretionary surtax on documents taxable under s. 201.02, except documents involving only a single-family residence (Fla. Stat. § 201.031).

StatewideA 3-inch by 3-inch space at the top right-hand corner on the first page and a 1-inch by 3-inch space at the top right-hand corner on each subsequent page are reserved for use by the clerk of the court.
StatewideThe name and post-office address of each person who executed the instrument and of each witness must be legibly printed, typewritten, or stamped on the instrument, and the name of any notary public or other officer taking acknowledgments must be printed beneath that officer's signature. The clerk may, in her or his discretion, accept an instrument with a name or address in another position if the connection is apparent. Section 695.26 does not apply to instruments executed before July 1, 1991, court decrees, orders, judgments, or writs, instruments executed, acknowledged, or proved outside Florida, wills, plats, or instruments prepared or executed by a public officer other than a notary public.
Re-recorded instruments must include a statement placed on the first page as to why it is being re-recorded, along with the book and page of the previously recorded document. Documents referencing a previously recorded document must include the Official Record Book and Page number of the original document. Deeds should include either the sale/transfer price or the amount of documentary stamp tax.
