Document Requirements

-Documents should be submitted on 8.5x11 inch white paper, with black ink in a font size of at least 10 point.

-In the upper right corner of the first page, there should be a blank margin of 3 x 5 inches. All other margins should be at least 1 inch. Documents without the 3 x 5 space will be charged an additional $12.

-Original signatures must be used in the document.

-If a deed has an attached rider, this should be permanently attached as an additional page on the back of the deed.

-Names of parties shall be typed or printed beneath signatures.

-The name and address to where future tax statement should be sent needs to be supplied on the deed.

-The preparer of the document should be listed on the first page. This can be given in the following format: "This instrument was prepared by NAME AND ADDRESS."

-A legal description of the real property should be by metes and bounds, and should contain the section, township, and range with an identifiable point of beginning.

-The property address must be included, as well as Property Index Number.

-If the grantor fails to provide the grantee with either a permanent index number or numbers that represent the legal description found in the deed or instrument of conveyance, the grantor shall be personally liable to the grantee for taxes pursuant to Section 1-145 of the Property Tax Code and attorney's fees.

-No deed or other instrument shall be construed as releasing or waiving the right of homestead, unless the same shall contain a clause expressly releasing or waiving such right. And no release or waiver of the right of homestead by the husband or wife shall bind the other spouse unless such other spouse joins in such release or waiver.

-The seller of residential real property should provide the buyer with a written disclosure statement (Residential Real Property Disclosure Report). This statement can be found in the Illinois Compiled Statutes, 765 77/35.
