The Recorder's Office in Sevier County, Utah is responsible for recording all real property documents for the county and for maintaining an abstract or index for the recorded documents. Warranty deeds, easements, and many other documents pertaining to real property located in Sevier County are recorded with the county recorder. All fees, including fax fees, must be paid in advance before recording can take place. The Recorder's Office does not give legal advice, give legal descriptions over the phone, or interpret legal documents.

Document Formatting Requirements

Documents submitted to the county recorder must be originals with original signatures and are required to be written in the English language. If written in another language, the document must be accompanied by an accurate English translation.

The proof of the execution of a conveyance whereby real estate is conveyed or might be affected may be: (a) by the testimony of a subscribing witness, if there is one; or (b) when all subscribing witnesses are dead, or cannot be had, by evidence of the handwriting of the party, and of a subscribing witness, if there is one, given by a credible witness to each signature.

No proof by a subscribing witness should be taken unless the witness is personally known to the officer taking the proof to be the person named in the conveyance as a witness thereto, or shall be proved to be such person by the oath or affirmation of a credible witness personally known to such officer.

Use white paper that measures 8.5 x 11 inches. Sheets of paper should not be continuously bound at the top, sides, or bottom. Printing should be single-sided only. Use black ink and a font size that is not smaller than 7 lines of text per vertical inch. Documents must be sufficiently legible in order to enable the recorder to make certified copies.

Margins on all sides should be at least 1 inch. However, on the first page, provide a blank space that measures 2.5 inches down and 4.5 inches across in the upper right corner.

At the top of the first page, provide a brief caption or title that states the nature of the instrument.

Instruments should have the typed or printed names of each person whose signature appears on the instrument whose name is required to be indexed. The typed or printed name should appear legibly beneath the corresponding signature.

A document may not be presented for recording if it does not contain a legal description of the property. Documents must have serial numbers for all legal descriptions.

To facilitate the abstracting of an instrument, some county recorders require that the applicable tax serial number of each parcel described in the instrument be noted on the instrument before it is presented for recording. The tax serial number is not considered part of the legal description and may be placed in the margin of the instrument if it is required.

The grantee's mailing address, which is used for assessment purposes and taxation, is required.

* Water Rights Addenda

If submitting a deed that conveys a fee simple title to land or if conveying water rights without conveying title to land, a water rights addendum must be included with the deed when it is presented for recording.

A water rights addendum identifies and describes the water rights that are transferred under an applicable deed or states that no water rights are transferred under the applicable deed.

The grantor is required to complete and sign the water rights addendum. The grantee should sign the addendum to acknowledge receipt. The grantee's signature can be a facsimile or done by electronic means.


Each document that is executed, acknowledged, and certified in the manner prescribed by Utah statutes, will, from the time of recording with the appropriate county recorder, impart notice to all persons of its contents.

Failure to record: Each document that is not recorded as required is void as against any subsequent purchaser of the same real property, or any portion of it, if: (1) the subsequent purchaser purchased the property in good faith and for a valuable consideration; and (2) the subsequent purchaser's document is first duly recorded.
