Under the Alaska Statutes, the beneficiary of an interest in property may disclaim the gift, either in part or in full (AS 13.12.801 Uniform Disclaimer of Property Interests Act). Note that the option to disclaim is only available to beneficiaries who have not acted in any way to indicate acceptance or ownership of the interest (AS 13.12.801 (j)).

The document must be in writing and include a description of the interest, a declaration of intent to disclaim all or a defined portion of the interest, and be signed by the disclaimant (AS 13.12.801 (f)).

File the disclaimer within nine months of the transfer (e.g., the death of the creator of the interest) in the court of the judicial district that has jurisdiction over proceedings regarding the administration of the estate of the deceased donor. In addition, deliver a copy, either in person or via registered or certified mail with return receipt, to the personal representative or other fiduciary of the decedent or done (AS 13.12.801 (b)). If real property is involved, record a copy of the document in the office of the recording district in which the property is located in order to avoid any ambiguity regarding the chain of title (AS 13.12.801 (e)).

A disclaimer is irrevocable and binding for the disclaiming party and his or her creditors (AS 13.12.801 (i)), so be sure to consult an attorney when in doubt about the drawbacks and benefits. If the interest arises out of jointly-owned property, seek legal advice as well.

After some initial general confusion -- (we sold a small piece of land privately and therefore do not typically prepare such documentation (!)) -- we were able to purchase and download all forms from Deeds.com and understand how to complete it/them. The help is all there, we just needed to read and study it - the "Example" helped alot. We were able to complete the Document per your online form(s) and then take it to be signed/notarized - and take the completed paper document to the Registry -- and it is now all registered and we are All Set. rn Took the morning (only). I thought the forms were reasonably priced, the instructions included in the packet were thorough, and the examples helpful. Thank you for the additional CDR forms too. I contacted the Recorder's office via email with a question and Jennifer Bowser answered promptly. Job well done! However, when I delivered the deed and Real Property Transfer Declaration to the Clerk's office in Lafayette, the clerk was unfamiliar with the Declaration document being submitted and it took some time to convince her to submit the form without charging the recording fee. She even tried to phone the recorder's office for clarification, but no one answered. There then was an additional form at that office that I had to complete called Recording Request/Transmittal Form. I would suggest including that form with instructions in your on-line packet to speed up the process when a Deed is delivered to the County Clerk's satellite office. I do not expect every clerk to know all the particulars of recording requirements but a little knowledge wouldn't hurt.

Best Way EVER to record a warranty deed! It was nice to not have to drive anywhere and find the facility closed or "unable to process due to covid19 and buildings being closed". The correspondence between me and deeds.com was very timely in our back and forth email correspondence, and the processing was all finished in a timely manner. Totally worth the extra $15 that I paid in addition to the recording fee. I would use this again and again. My time and the efficiency of the job completed is worth the money.

Downloaded and used the Ladybird Warranty Deed for a county in Florida with no issues. Cost for the download and subsequent recording fee of the deed totaled less than $40. No reason to pay hundreds. I assume the subsequent transfer upon death will go smoothly, but I of course, will never know. The "example" of a completed form was very beneficial. Also, get a copy of the current deed and make sure legal description of real estate is exactly the same on the new deed.

The form was short, and explainable.. so that is my feed back on that...but we have not received anything back to actually see if we filled the form out correctly.
