Under A.C.A. 28-73-1013, a trustee can furnish a certification of trust in lieu of the trust instrument to prove his or her authority to act on behalf of an established trust.

The certification is an official document a recipient can rely upon, and assume without inquiry the existence of the facts contained within (28-73-1013(f)(1)). The document contains only information about the trust deemed relevant to the immediate transaction for which it is requested. The recipient has the right to request excerpts from the trust document containing the information presented in the certificate, but this opens the recipient to certain liabilities (e),(h).

The certification includes basic information such as the name, date, and type (revocable or irrevocable) of the subject trust, and verifies that the trust has not been revoked, modified, or amended in any manner that would cause the representations contained in the certification of trust to be incorrect (c). It discloses the identities of the trust's settlor and all acting trustees, but maintains the confidentiality of anyone having a beneficial interest in the trust. The powers of the trustee relevant to the conveyance of trust property are enumerated, as well as any requirements for authenticating documents in the case that there are multiple trustees. Finally, the certificate establishes the name by which a trust will vest title to real property.

As with all documents relating to real estate, the certification should contain a legal description of the subject property. This is the same legal description found on the deed conveying the property into the trust. The certification of trust is signed by any trustee in front of a notary public before it is recorded in the county in which the subject property is situated.

Really solid system for determining what may prevent your documents from being accepted. I love the comments section allowing for fluid communication. I only wish there were automated emails for all those communications and once documents were accepted, but I did receive a couple personally-generated emails regarding the progress instructing me to check the site.

The service was great but after I did all my work and uploaded the documents they canceled my stuff because the county they had on the list doesnt take/or have set up e-recording yet. It was a bit disappointing because thats the only reason I was on here is because it brought me here from that countys sight.

Really good product, included guide to filling out forms. Totally pleased with that part. Customer service however was terrible. Did not hear back after I sent two emails. The site signed me up but after I was accepted they would not allow me to download a form, with the notation my account was closed. Had to use another email. Had problems with that. Finally got off of site and went to a login site that allowed me to download the forms. If you can get past setting up your account, it is fantastic site. Nice price compared to alternatives. Also I recieved two validation codes. Have no idea why they were sent.

The paperwork/forms are fine, but there isn't enough explanation for me to figure out how to file the extra forms (which I do need in my case). The main form, Deed Upon Death is fine. I think the price is pretty high for these forms. I wouldn't have purchased it because there are places to get them for much cheaper (about 6 dollars), but this site had the extra forms I wanted (property in a trust and another form). Unfortunately these were included as a "courtesy" and there are no instructions for them. So three stars for being clear about what was in the package, having the right forms that I need, but instructions for putting them to use and price took a couple of stars off. Downloading was easy and once you download you can type the info into the PDF--that makes working with the forms much easier.
