Use the disclaimer to renounce an interest in real property in California.
A beneficiary in California can disclaim a bequeathed asset or power. For a complete list, see Probate Code 267. A disclaimer, which must be in writing and signed by the beneficiary, allows that beneficiary to renounce his or her interest in the property. California statutes allow for the partial rejection of the interest, which must be clearly identified on the disclaimer.
Besides the beneficiary, state the name of the creator of the interest, as well as the next beneficiary to whom the interest will pass, e.g., the next person in line to inherit. In the case of real property, give the entire legal description of the land and provide recording information for the prior deed in order to avoid any problems in the chain of title.
A disclaimer is irrevocable and binding for anyone who makes a claim against the beneficiary, for example, potential creditors. It must be received within nine months after the decedent's death, the transfer, or the 21st birthday of the beneficiary (Probate Code 279) and is only valid if no actions have indicated acceptance of the property.
It must be filed with any of the following entities according to Probate Code 280(a): the superior court in the county where the estate is administered; the representative of the deceased or executor of the estate; the creator of the interest; or "any other person having custody or possession of or legal title to the interest." When in doubt as to the drawbacks and benefits of renouncing the property, consult with an attorney.

Was driven to this site by the county website. It took a bit of work having to create an account, etc. The example was useful; however the example only showed both parties in the same county, nor did the instructions mention anything about differing counties. This caused an oversight on my part.

I purchased this form to add my boyfriend to the deed of our home. He owns his own business so he cannot be on our mortgage. The guide doesn't clearly explain adding a person rather than focusing on transferring during a purchase or selling of a home. For future, I'd recommend make a few different examples for those who are trying to use this for the other options a Quit Claim Deed is needed for.

As a first time user and not having knowledge of how your site worked it was awkward to upload a file and not know what to do next. I found out there is nothing to do next but that after some time looking for a submit button or some kind of confirmation that I was doing the right thing. The Transfer on Death Deed form package was very good. But like anything, could use some improvements. There is not enough space to fill more than one beneficiary with any level of additional detail like "as his sole and separate property" The area for the legal description could be a bit bigger and potentially fit many legal descriptions. Or it could be made to simply say "See Exhibit A" as is likely necessary for most anyway. The guide should indicate what "homestead property" means so the user doesn't have to research the legal definition. (which turns out to be obvious, at least in my state, if you live there, it's your homestead.) It would be helpful if an "Affidavit of Death" form were included in the package for instances where the current deed hasn't been updated to reflect a widowed owner as the sole owner before recording with only the one signature.
