The Current holder of the Security Deed uses an "Assignment of Security Deed" to transfer the instrument to another party. This is typically done when the Security Deed has been sold, this allows the new lender to collect payments on the debt.

Georgia Statute: 44-14-64
(g) A transfer of a deed to secure debt shall not be recorded unless it includes the mailing address of the last transferee thereof. Failure to comply with this provision shall not be a defense to any foreclosure or grounds to set aside any foreclosure of any deed to secure debt.

Current Borrowers must be notified of the assignment. Notification consists of contact information of the new creditor, recording dates, recording instrument numbers, changes in loan, etc. Included are "Notice of Assignment of Security Deed" forms.

The Truth and lending act requires that borrowers be notified when their Security Deed has been sold, transferred, or assigned to a new creditor. Generally, within 30 days to avoid up to $2,000.00 in statutory damages, plus reasonable attorney's fees. Systematic violations can reach up $500,000.00.

It all started out well, then I was abruptly told that I would have to submit the documents directly to the recording office. No explanation was offered and I wasted a lot of time on your website for nothing. Very disappointing, as the concept of e-recording is what is needed in 2026.

We reviewed your order and our support messages. The document uploaded for recording was a very low-quality scan that did not meet the county’s eRecording image requirements. Our staff asked that a clearer scan be uploaded, but the same image was submitted again.

Because the document could not be processed electronically, we advised recording it directly with the county recorder’s office.

E-recording systems require clear, legible document images that meet county standards. When those requirements cannot be met, recording directly with the recorder is often the fastest option.

Might be adequate if I was desperate. Formatting screams amateur hour -- not a legal issue but likely to invite closer scrutiny when filed. Instructions were supposed to be county-specific but directed me to call the recorder to ask them how to fill out part of the form. Not planning to use the form and would not purchase it again. I could probably do better by uploading some examples and the original mortgage from the Recorder's website into Claude along with the transaction-specific information and asking Claude to prepare a more professional release.
