Georgia Certification of Trust
Under O.C.G.A. 53-12-280, a certification of trust is the document a trustee uses to establish the existence of trust provisions. The trustee furnishes the certificate to a party other than a trust beneficiary (someone who has a beneficial interest in the trust) in lieu of providing a copy of the full trust instrument. The certificate's purpose is to verify the trust's existence and the trustee's authority to act under the trust.
In trusts affecting real property, the trustee is the person who holds legal title to the real property ( 53-12-2(16)). The trustee's powers are established in the trust instrument, which is executed by a settlor in the creation of a trust.
The certificate contains only the essential information about a trust, including the name and date of the trust and identities of the settlor and acting trustees, as well as any successor trustees. The identities of those having a beneficial interest in the trust remain undisclosed. In addition, the certificate states how trust property should be titled, and whether or not the settlor has the power to revoke the trust. The trustee's powers relevant to the management of trust property are enumerated, as well as restrictions, if any, concerning those powers.
Some third parties might request copies of relevant sections of the trust instrument ( 53-12-280(d)), even though Georgia statutes confirm that the details contained within the certificate are to be presumed correct. This presumption suggests that the recipient of a certification of trust is not liable for actions based on false information given within ( 53-12-280(e)).
Like all recorded documents concerning real property, the certificate should also contain a legal description of the real property subject to the trust, including the property's parcel identification number. The document is executed and acknowledged by all trustees in front of a notary before it is recorded in the county wherein the real property subject to the trust is located.

I appreciated the fact that the forms were by Texas County and I knew I had the right form. The form were fairly easy to complete. I had trouble completing the form because the property description was long and kept disappearing and I had to re-type. It would also have helped it I could have saved and not had to start over every time.

I am beginning to beliece that there is no search intrrfaxe here; just a long list of instructions full of circular references that simply tuns the researcher around and around to the same pages repeatedly. This service takes users NOWHERE. Good luck to those seeking to waste their time reading a vast set of redundant words and NO INTERFACE FOR CREATING OR EXECUTING AN AXTUAL SEARCH.

This was easy to use and only contained one glaring error-where to send the completed form to finish the process. I’ve completed the form, does this mean I get the amended deed sent to me? I think not.

Good template that met my needs. Much better than another draft template that I found on another site. Would have been helpful if the template had been provided in a Word format instead of PDF so that I could remove the sections that are not applicable.

I downloaded the Lady Bird deed. The process was quick and easy to download. Just select your county, fill out the form. You will need the property description from your original deed. In my case I had to go downtown Wayne County (Detroit). (Make an appt online). 1st you will have to get the property tax certified to ensure all taxes are paid to date (5th floor at the Wayne County Treasurer office). Give them the form you just filled out and they will stamp certified $5. After that take the form to the Register of Deeds (7th floor) appt needed. $18. Make sure it is properly notarized and all signatures completed. Once approved, they will scan it, stamp it, give it back with a receipt and mail a copy also. All Done. Worked beautifully. My co worker go a lawyer and paid over $250. I just used deeds.com and total for forms and going downtown with notarizing was less than $40 Yea!

Very Poor and useles, a scam, don't waste your money, those templates are useless and do Not give you Any valid,proper, meeningful wording to use, did Not Help me, nothing more than what a 5th grader can come up with as far as wording or example..I feel I was riped off and this is a total scam... nothing useful
