How to Contest a Recorded Claim of Lien in Georgia
In the State of Georgia, an action to enforce a recorded claim of lien must be commenced within 365 days of recording the lien claim. O.C.G.A. 44-14-361.1(a)(3). In addition, within 30 days after commencing such lien action, the party claiming the lien must file a notice of the action with the clerk of the superior court of the county where the subject lien was filed. Id.
Many states, including Georgia, provide the property owner with a method to protect his or her property by allowing the owner to file a notice shortening the time for filing an enforcement action. In Georgia, that procedure is called a "Notice of Contest of Lien." O.C.G.A. 44-14-368.
Under this process, an owner or an owner's agent or attorney, or the contractor or contractor's agent or attorney, may elect to shorten the time set in which to commence a lien action to enforce any claim of lien by recording in the superior court clerk's office a notice of contest, along with proof of delivery upon the lien claimant. O.C.G.A. 44-14-368(a). The notice should contain the lien claimant's name and address, the date the lien claim was filed, the recorded lien book and page number, the name of the county where the claim of lien was filed, and the property owner's name. Id.
The Notice must also be served on the claimant by sending a copy of the Notice of Contest of Lien within seven days of its filing by registered or certified mail or statutory overnight delivery to the lien claimant at the address noted on the face of the lien. O.C.G.A. 44-14-368(b). Service is deemed complete upon mailing. Id.
The lien will be extinguished by law 90 days after filing the notice of contest of lien if no notice of commencement of lien action is filed within that time period. O.C.G.A. 44-14-368(c). No additional release or voiding of such liens is required. Id.

Website is easy to use. I ordered the form, filled it out and uploaded it for recording. My only critique is that you can't preview the form before ordering and paying for it. I ordered a Deed of Full Reconveyance form only to find out I needed the Substitution of Trustee and Deedn of Reconveyance form instead. So I wasted $22 on the wrong form.

The paperwork/forms are fine, but there isn't enough explanation for me to figure out how to file the extra forms (which I do need in my case). The main form, Deed Upon Death is fine. I think the price is pretty high for these forms. I wouldn't have purchased it because there are places to get them for much cheaper (about 6 dollars), but this site had the extra forms I wanted (property in a trust and another form). Unfortunately these were included as a "courtesy" and there are no instructions for them. So three stars for being clear about what was in the package, having the right forms that I need, but instructions for putting them to use and price took a couple of stars off. Downloading was easy and once you download you can type the info into the PDF--that makes working with the forms much easier.

I thought the instructions could have been a little better. I didn't know how to do this if the spouses are married but living in separate residences. Also I didn't understand the "Prior Instrument Reference". That should be explained better. Very sketchy instructions.

Lee County, FL did accept the "Satisfaction of Mortgage" form. It was easy to fill out except for a couple of areas. Your fill in areas need to accommodate for whatever space needed for the pertinent information we as customers have to fill out. As individuals, banks have their own. Example when there are more than 1 party and information needed. Example of Document #; I was 1 number short (using Exhibit A was ridiculous.) So I had to write in the # after printing. Very unprofessional looking on a legal document. Just saying. Also, in Lee County, FL your document # is called "Instrument #, not said in your instructions. Hope this information helps for updates on your forms.
