Cancelling a Georgia Mechanic's Lien After Payment
To dissolve previously filed mechanic's lien claims, claimants must file a Release of Claim of Lien. Construction liens must be canceled once payment has been received, the lien expires, or for any other reason. The lien release must be filed with the county recorder to cancel the previously filed lien instrument. The lien release is different than a lien waiver because it discharges an already filed lien, while a waiver surrenders the right to file one in the first place.
A Release form contains the following information: 1) lien claimant's name and address; 2) property owner's name and address; 3) address of the subject property; 4) date the lien was recorded; 5) the book number, page number, and instrument number as indexed by the county; and 6) reason for cancellation (lien has been paid, expired, or any other reason for discharge). The Release must be signed in front of a notary public who then signs as a notary and/or affixes his or her seal.

Quick and easy! I had previously prepared a Lady Bird deed, submitted it through Deeds.com and it was accepted/recorded by my county in just a few hours. Deeds.com recorded documents for me without any issue. It's a good service and provides a lot of assistance on its web site. However, I asked for a printed receipt (i.e. an pdf copy of one), but after a staff provided me with an obvious answer, they simply ignored my follow up requests. I also asked a simple formatting question that they should have been able to answer; instead, they passed the buck and referred me to the recorder, which currently is a very time-consuming venture. They also have no telephone number for any issue. Generally, the service saves me the time and effort of physically recording a document, but when you think about $19.00 per recording seems like a steep price for the services rendered.

While it's nice to get all the forms and info in one package for a reasonable cost, the fixed format of the form does not allow for a lengthy meet and bounds property description for real property. Also, the Cover Sheet has big fillable sections with no instructions about what's supposed to go there. I tried the "Contact Us" link, but all it does is spin saying it's trying verify the security of my connection. Looks like I;m going to have to create my own deed in MS Word instead of just filling in the blacks of the PDF file that I downloaded. Bummer!
