Indiana outlines the rules for its transfer on death deed in I.C. 32-17-14 -- the "Transfer on Death Property Act."

Indiana transfer on death deeds transfer ownership rights of real property to a predetermined beneficiary after the owner's death. This enables Indiana residents to pass their real estate to their heirs outside of probate. The owners keep full control over the property during their lives -- the conveyance only occurs after the owners die -- so they may sell, rent or use the land as they wish. They may change the designated beneficiary or cancel the entire transfer by simply executing a revocation that redefines their wishes.

Note that this is only valid when it is executed (signed) and recorded WHILE THE OWNER IS STILL ALIVE. If not, the deed is void and the property passes through probate with the rest of the owner's estate.

I tried 3 local attorneys and got no where , wrong information, to busy and another one was very rude. One said he'd do it then didn't. I was so stressed and tried a different online form company advertising an in person attorney within hours. They did call back but gave me the wrong answer. I needed a form used in NC and knew about it from the clerk of the court. The deadline was approaching, I looked one more time and found Deeds.com. They have the form and the much need instructions and for less than $30.00. I am so pleased and also relived!

In Colorado a Release of a Deed of Trust without the original note must be efiled - the Recorder said it had to be Simplifile or CSC Global neither of whom are designed to do a 1 off filing (you have to subscribe). Fortunately, I found Deeds.com - they were great. helped me work through a couple clerical issues and it is done. I am so happy and pleased. I would give them more stars if I could. I will spread the word among the realtors and title companies who couldn't help that there is a better option.
