Acknowledging a Satisfied Lien Claim in Iowa

Lien claimants are required to file a certificate of satisfaction under Iowa law when an underlying lien has been paid off or otherwise fully satisfied and the owner has made written demand for its discharge. The certificate instructs the clerk of records to strike the lien from the record upon a sworn statement by the claimant that the lien should be discharged.

When a mechanic's lien is satisfied by payment of the claim, the claimant must acknowledge the liens satisfaction upon the mechanic's lien book, or otherwise in writing, and, if the claimant neglects to do so for thirty (30) days after demand in writing is personally served upon the claimant, the claimant shall forfeit and pay twenty-five dollars to the owner or contractor, and be liable to any person injured to the extent of the injury. I.C. 572.23(1).

If acknowledgment of satisfaction is not filed within thirty (30) of the demand in writing, the party serving the demand or causing the demand to be served may file for record with the clerk of the district court a copy of the demand with proofs of service attached and endorsed and, in case of service by publication, a personal affidavit that personal service could not be made within the State of Iowa. I.C. 572.23(2).

Upon completion of the requirements for filing the certificate of satisfaction, the record of the lien's discharge will operate as a constructive notice to all parties of the due forfeiture and cancellation of the lien. Id.

A better or more simplified explanation of what some of the more common titles would be used for would help. You list 6-8 types of Trusts alone. An example of doing a Grant Deed to move a property into, out of, or from a Trust to a Trust would have been helpful.

I love deeds.com - hands down, the quickest way to record a warranty deed. The process and communication is so quick - the recording transaction too. Worth the extra $20 to me for my time! I didn't spend over an hour driving around, talking to someone via a kiosk to record the deed, didn't have to spend the energy of loading kids into the car to come with me, etc. The efficiency and timely process is worth the cost! The documents themselves are fine and the information provided with them is helpful. I find the actual processing of the documents, however, to be difficult particularly once the document has been saved. First, I note that the box for the date only allows entry of the last 2 digits of the year. Unfortunately, my download only allows me to enter one of the 2 digits required. When I delete it repeatedly, it eventually allows both digits to be entered but puts them in extremely small text and in superscrypt. I have not found a solution to this problem and am not sure the deed can even be recorded with this problem.

Another problem is that if you try to revise the document after you have saved it the curser goes to the end of the line after each key entry. This means that there basically is no way to efficiently save the document for reworking later since you will have to delete everything you have entered in the text box unless you only need to make a single keystroke change or are willing to replace the curser after each entry. Try that with a long property description!

Please note that I am using a Mac to prepare my documents and perhaps this is part of an "incompatibility problem". However, I didn't see a disclaimer regarding Mac use and so would expect the documents to perform correctly. Overall, I give the program a "2 star" rating because I am experiencing significant difficulties in entering dates in the documents even before saving them and because saving your work for later revision appears to be basically unworkable.
