Claiming a Mechanic's Lien in Iowa
Mechanic's liens are used to encumber the title to an owner's property when a contractor, materials supplier, or other laborer such as a subcontractor has not been paid for labor, materials, or equipment provided. In Iowa, this is accomplished by filing a Claim of Lien with the district court.
Iowa law entitles every person who furnishes material or labor for, or performs any labor upon, any building or land for improvement, alteration, or repair thereof, by virtue of any contract with the owner, contractor, or subcontractor to have a lien upon the building or improvement, and land belonging to the owner, to secure payment for the material or labor furnished or labor performed. I.C. 572.2(1).
The entire land upon which any building or improvement is situated, including that portion not covered therewith, shall be subject to a mechanic's lien to the extent of the interest therein of the person for whose benefit such material was furnished or labor performed. I.C. 572.5.
Perfect the lien by filing it with the clerk of the district court of the county in which the building, land, or improvement to be charged with the lien is situated. I.C. 572.8(1). NOTE: The lien must include a verified statement of an account of the demand due to the claimant, after allowing all credits. Id. The statement must set forth: 1) the date when such material was first furnished or labor first performed, and the date on which the last of the material was furnished or the last of the labor was performed; 2) the legal description of the property to be charged with the lien; and 3) the name and last known mailing address of the owner of the property. Id. Upon the filing of the lien, the clerk of court will mail a copy of the lien to the owner. I.C. 572.8(2).
The statement of account must be filed by a principal contractor or subcontractor within two years, and ninety days after the date on which the last of the material was furnished or the last of the labor was performed. I.C. 572.9.

Review: Deeds.com had much better and fuller information than any other help i found (90% complete vs 60 % complete); they tout how up-to-date they are on all the counties in the country and the idiosyncrasies of each county's forms and procedures; but some minor points of the info i needed were missing or confusing. Including that they sold me on e-Recording my deed through them, only to find out after i had done all the prep for that, that they had failed to tell me upfront (or i missed it somehow) that the county i was dealing with did not yet accept online recording. So, they were by far the best i found, but not 100%.

Review: From Pennsylvania here. Documents are great and easy to fill out however you are lacking a couple of things. You only provide the option for a Grant Deed when you purchase by your county which is Mercer County for me. Why not give the ability to get a Warranty Deed that better protects the Grantee? Also, being from Pennsylvania and in a county that mined Buituminous Coal we are required to include the Coal Severance Notice and Bituminous Mine Subsidence and Land Conservation Act Notice. You can check the box on your Deed form that they are required and attached but you do not provide the verbiage or form for this. You state that you know what each county requires and include everything required but you do not include these two required Notices. This has been a requirement for years and the wording never changes. I had to look for these Notices and hand type this information and include it on another seperate page after the Notary section on the Deed. The Grantor has to sign the Coal Severance Notice and be witnessed by a Notary so I had to add another place for the Notary and will have to pay twice for witnessed signatures when it could have been included in your document. My Deed from 2003 was done that way and then the Notary statement after that so it was only one notarized witness of signature.
