Once the contract is fulfilled, terminated, or void, the recorded memorandum needs to be released to:
1. Clear Title
A recorded memorandum clouds the title and may prevent:
Refinancing
Selling the property
Title insurance being issued
Releasing it removes the cloud and restores a clear record of ownership.
2. Document the End of the Agreement
A release shows that the agreement no longer has legal force.
It protects both parties from future disputes or claims.
3. Protect Future Buyers
Prevents confusion or legal complications for a future buyer or lender who may otherwise believe the contract is still active.
When to Release a Memorandum of Contract
You should release the memorandum as soon as one of the following happens:
1. The Contract is Completed
The buyer made the final payment and received the deed.
At this point, the contract for deed is fulfilled, and the memo should be released.
2. The Contract is Terminated
Due to buyer default
Mutual agreement to cancel
Abandonment of the property
Any reason the deal is no longer in force
In these cases, the party who recorded the memorandum (usually the buyer) should file a Release of Memorandum of Contract with the County Clerk where it was originally recorded.
3. By Court Order
If one party refuses to release it (e.g., an uncooperative buyer), the other party may file a quiet title action and obtain a court order to release it.
Who Releases It?
Typically the buyer (as the “releasor”), because they usually record the memorandum.
But if the buyer is in default, the seller may need to:
Request the release
Or take legal action to force it
Record with the County Clerk’s office.

The documents' format contained information needed to complete the necessary paperwork for filing with Georgia. However, the fields were not large enough to put the legal description in, and there was no way to enlarge the area. These were only semi-helpful in providing what I needed per Georgia's filing requirement.

I liked the software, it's very easy to use. Once it's saved as a .pdf document on your computer, the source document is lost when you log out. I wish it could be saved and then edited on their site later instead of having to create a new document from scratch each time.

When I found this website, I was confused and hesitant to use this website to submit paperwork that needed to be submitted to the Clerks of Courts in Miami. I am glad I decided to go through with it. This was such a money saver. I was told by someone at the courthouse that I had to have a lawyer prepare the paper work for my mom. They stated that family members couldn't prepare the papers. I was hopeful when I found that I could prepare the survivorship affidavit on Deeds. I was able to prepare everything myself and had no issues today when at the courthouse for all the changes. A better or more simplified explanation of what some of the more common titles would be used for would help. You list 6-8 types of Trusts alone. An example of doing a Grant Deed to move a property into, out of, or from a Trust to a Trust would have been helpful.

I purchased this thinking I would be able to complete the QuitClaim Deed myself because an example was provided, but you still need to be a lawyer to figure all the wording out. It was not worth the price I paid for it.

Waste of money. The deed form was not printable after completion. Had to create a new form in word on my own.

I followed the instructions to download the form for my Mac, typed in the legal description of the real property but the space provided for it would not expand so I just typed the form into Word as a document. While I appreciate having the form to work with it would have been a breeze if it worked properly.
