During the construction process, a property owner (or his or her lessee) may ask the contractor for a mechanic's lien waiver in exchange for a full or partial payment.

Michigan law defines four permissible types of lien waivers. These include: (1) Partial Unconditional Waiver, (2) Partial Conditional Waiver, (3), Full Unconditional Waiver, and (4) Full Conditional Waiver. M.C.L. 570.1115(9).

Use a full unconditional waiver of lien when the claimant receives full payment for his or her contract from the owner, lessee, or designee. M.C.L. 570.1115(2).

A waiver of a lien will be effective when a person makes a payment relying on the waiver, unless at the time the payment was made, the person making the payment had written notice that the payment or consideration for the waiver has failed (i.e., the check bounced at the bank). M.C.L. 570.1115(6).

Lien waiver forms must be in writing and must comply with Michigan law to be valid. Include the names of the contractor and the property owner, and identify the property covered by the recorded lien.

Lien waivers can be confusing and issuing the wrong kind of waiver (or issuing one too early) can result in dire consequences for mechanic's liens. Contact an attorney with questions about waivers or any other issues related to liens.

Worked well for me to create a deed for a house I inherited. It was very thorough and easy to use. I have no experience with the law so I just googled terms I didn't understand and was fine. I also called land records a lot and ended up not needing a lot of the material included, but it was still good to have it.

Deeds.com recorded documents for me without any issue. It's a good service and provides a lot of assistance on its web site. However, I asked for a printed receipt (i.e. an pdf copy of one), but after a staff provided me with an obvious answer, they simply ignored my follow up requests. I also asked a simple formatting question that they should have been able to answer; instead, they passed the buck and referred me to the recorder, which currently is a very time-consuming venture. They also have no telephone number for any issue. Generally, the service saves me the time and effort of physically recording a document, but when you think about $19.00 per recording seems like a steep price for the services rendered.

My overall experience was positive. Little trouble uploading documents but resolved. I had two mineral deeds to file in Arkansas, two different counties, exactly the same form, only difference being property description; one was completed, one was canceled. I emailed to inquire why and the reply was in an automatic email indicating that email address was not monitored and if further action would be taken on Deeds.com part, I would be notified. Other than that, I would recommend their services to avoid using snail mail.
