This form is executed by the current mortgagee named in the mortgage to (waive the priority of the mortgage in favor of another)(mortgage by executing a separate instrument acknowledged in the same manner as required for deeds and other instruments for the transfer of an interest in real estate. The waiver is effective to the extent of the mortgage waived.) When recorded (the waiver is constructive notice of the waiver to all persons dealing with the mortgage or with property described in the mortgage from the date the waiver is recorded.) Form and instructions were useful. But I suggest creating a form for transferring a deed pursuant to a trust. The existing form is based on a will going through probate so it doesn't fit the trust situation in some respects.

I needed to create a deed of distribution for my probate case. The instructions as to what was needed on the caption page was lacking. Because of the lack of information I still had to have an attorney review the documents as I didn't feel confident in the instructions given.
