Using a Notice of Furnishing in Michigan
Proper notice is key to a successful lien claim. A Notice of Furnishing is a type of preliminary notice that must be provided to a property owner by a subcontractor, contractor, laborer, or supplier as a condition to obtaining a later mechanic's lien covering the full amount of labor or supplies. This Notice must be sent by any party who has not contracted directly with the owner to preserve that party's lien right.
In Michigan, a subcontractor or supplier who contracts to provide an improvement to real property must provide a Notice of Furnishing to the designee and the general contractor, if there is one (as named in the Notice of Commencement) at the address shown in the Notice of Commencement, either personally or by certified mail, within 20 days after furnishing the first labor or material. M.C.L. 570.1109(1).
The Notice of Furnishing must contain the following information by law: (1) the name of the owner (or designee or lessee) as noted in the Notice of Commencement; (2) the name and address of the claimant furnishing materials or services; (3) description of services or materials furnished; (4) the book number and page number in the county recording index (and name of county where recorded); and (5) proof of service on the property owner. M.C.L. 570.1109(4).
If the lien claimant fails to provide a Notice of Furnishing within the time specified, this will not defeat the lien claimant's right to a later construction lien for work performed or materials furnished by the lien claimant before he or she served the notice of furnishing. M.C.L. 570.1109(6). However, the lien will only be applied to the extent that payments were made by or on behalf of the owner or lessee to the contractor pursuant to either a contractor's sworn statement or a waiver of lien in accordance with this act for work performed or material delivered by the lien claimant. Id.
While subs and suppliers have 20 days to serve the Notice, laborers must serve it within 30 days of a wage claim arising. If a laborer neglects to serve the Notice of Furnishing on an owner's designee, though, the laborer loses the opportunity to file a lien claim for wages. M.C.L. 570.1109(8). If the laborer fails to provide a notice of furnishing to the general contractor within the required time, this will not defeat the laborer's right to a construction lien, but the laborer shall be liable for any actual damages sustained by the general contractor because of the failure. M.C.L. 570.1109(10).

Great product. It would be better if the document files were not embedded within other files. It made downloading a little confusing. The titles of the forms did not match exactly word for word, which required a lot of back and forth to make sure I had downloaded the proper document. What would be great is if once you download a document, the hyperlink changed color, or somehow denoted the document had been downloaded. Just a suggestion. You have my email address if you have questions. STILL! Five stars for you guys. I would not let that hiccup dissuade me from buying any form package from you guys. Thanks!

I found the process of downloading and completing the documents very user friendly. Thank you for the Declare Value instructions. It was easy to follow, though a sample of the declaration form would be very useful. I didn't know how to list my "capacity" so I left it blank so the recorder could advise me. The documents themselves are fine and the information provided with them is helpful. I find the actual processing of the documents, however, to be difficult particularly once the document has been saved. First, I note that the box for the date only allows entry of the last 2 digits of the year. Unfortunately, my download only allows me to enter one of the 2 digits required. When I delete it repeatedly, it eventually allows both digits to be entered but puts them in extremely small text and in superscrypt. I have not found a solution to this problem and am not sure the deed can even be recorded with this problem. Another problem is that if you try to revise the document after you have saved it the curser goes to the end of the line after each key entry. This means that there basically is no way to efficiently save the document for reworking later since you will have to delete everything you have entered in the text box unless you only need to make a single keystroke change or are willing to replace the curser after each entry. Try that with a long property description! Please note that I am using a Mac to prepare my documents and perhaps this is part of an "incompatibility problem". However, I didn't see a disclaimer regarding Mac use and so would expect the documents to perform correctly. Overall, I give the program a "2 star" rating because I am experiencing significant difficulties in entering dates in the documents even before saving them and because saving your work for later revision appears to be basically unworkable.

The beneficiary deed was acceptable to the county clerk and my notarized official deed was mailed to me. The Missouri-based deed met with official approval so all is well in the land that time forgot.

This is not at all the form that I needed. I am trying to disclaim my interest in a property, but this form is much too rigid to work for my case. It would have been nice to know some of the more specific details before purchasing the document.
