Buyers of real property must file this form if its sale price (or other consideration) is more than $1,000. Effective October 1, 2014, the Minnesota Department of Revenue will no longer accept the paper Certificate of Real Estate Value (CRV). Instead, the e-CRV is being implemented as an electronic replacement to the four-part paper CRV form. Transfer documents almost all require the electronic CRV and, if submitted with a paper CRV, will be rejected and required to be resubmitted with an e-CRV. Please consult the guidelines posted here for a specific list of documents.

Form 1 may be used to document your claim for an exempt or minimum tax transfer. This form lists 27 transfer tax exemptions. Form 2 is used if transfer tax is due and must be submitted within 30 days. Note: In the absence of a qualifying reason, deed tax must be based on at least the fair market value of the property being conveyed. The “full” deed tax rate is .0033 (.0034 for Hennepin and Ramsey counties).

What is the Minnesota Affidavit of Identity and Survivorship for Transfer on Death Deeds?

Affidavit of Identity and Survivorship for Transfer on Death Deeds -- Minnesota Form 50.2.3

Minnesota's transfer on death deeds are governed by Minn. Stat. 507.071.

To complete the transfer of property rights after the grantor owner's death, the beneficiary must file an affidavit of identity and survivorship in the county where the land is located (subd.20). The affidavit must contain details about the deceased grantor owner, all beneficiaries, surviving or deceased, a legal description of the real estate, recording information from the transfer on death deed, and the address of the individual or entity who should receive future tax statements.

In addition to the affidavit, include an official copy of the grantor owner's death certificate and a clearance certificate from the Minnesota Department of Human Services. All three forms are required, and may be filed as a unified document with references on the affidavit to the death certificate and clearance certificate, but each may also be recorded individually. Note that the transfer is not completed until all three forms are filed for record.

The beneficiary may complete an online request from the DHS website: https://edocs.dhs.state.mn.us/lfserver/Public/DHS-5893-ENG to obtain the clearance certificate.

Individual counties may require additional information -- check with the local agency responsible for maintaining land records with any questions.

Review: I liked having the forms. Some may need to know they can look at the legal Description from online county records, then type up in Word document line by line, the degree sign in Word program is achieved by using alt and 248 on number pad. Then on the form page one write SEE Exibit A and title your Word program description as Exibit A. Goes without saying the legal description should be looked over many times and it is easier to do so if you format your Word the same lineage as the legal description online which is usually not text which is why you have to retype it.

Review: I find your forms hard to use, inasmuch as the forms cannot be converted to a Word Document. Editing and deleting of extra lines is not possible, making for a deed with large blank spaces. Document that results is not usable for me.
