Use this form to transfer a Deed of Trust to another party. The holder of the Deed of Trust becomes the Assignor and transfers rights to the Assignee, this is usually done when a Deed of Trust has been sold. An Assignment of Deed of Trust (secured by a Deed of Trust or other lien of record, shall be entered on the margin of the record of the lien or said assignment shall be acknowledged and filed for record.) (Except as provided in Section 89-5-37) (89-5-17). [The assignment or transfer of a secured indebtedness need not be filed for record nor entered on the margin of the record if the holder thereof is represented by an agent, trustee or the like disclosed as beneficiary in the mortgage or deed of trust.] [MS Code 89-5-37]
Current Borrowers must be notified of the assignment. Notification consists of contact information of the new creditor, recording dates, recording instrument numbers, changes in loan, etc. Included are "Notice of Assignment of Deed of Trust" forms.
The Truth and lending act requires that borrowers be notified when their Deed of Trust has been sold, transferred, or assigned to a new creditor. Generally, within 30 days to avoid up to $2,000.00 in statutory damages, plus reasonable attorney's fees. Systematic violations can reach up $500,000.00.

Great product. It would be better if the document files were not embedded within other files. It made downloading a little confusing. The titles of the forms did not match exactly word for word, which required a lot of back and forth to make sure I had downloaded the proper document. What would be great is if once you download a document, the hyperlink changed color, or somehow denoted the document had been downloaded. Just a suggestion. Very disappointed that you had certain documents but did not have the accompanying documents needed to complete the transfer. I also had issues with the documents not allowing you to fill in the pages... example the document was prefilled in as so ... Page 1 of_____ but you could not fill in the blank... I tried reaching out to your customer service, but they had no solution for me. So, I had to write in the page, which didn't look professional. I think I could have gotten documents just as good for free if I'd research a little longer.

The Virginia Transfer on Death Deed and the Virginia Transfer on Death Beneficiary Affidavit are separate documents and are offered individually because many customers only need one, depending on their situation. In your case, the affidavit was later ordered separately.
Regarding the page numbering (“Page 1 of ___”), that field is intentionally left blank. The total number of pages is not known until the document is finalized, signed, notarized, and all attachments (such as exhibits or legal descriptions) are included. It is standard practice to complete that portion by hand at execution so the final page count accurately reflects the recorded document.

For future clarification to potential users, Deeds.com may want to categorize the type of easement documents that are available. I was needing a 'utility easement' form and received an 'ingress/egress' form. Had I known it was an ingress/egress document, I would not have made the purchase. Outside of this issue, this site is very helpful for the average layperson to hold guardianship over personal interests.
