This type of deed offers both an immediate transfer of the property's title and a mechanism for ensuring that the grantor can live on or use the property until their passing.
89-1-37. Effect of a conveyance without warranty. A conveyance without any warranty shall operate to transfer the title and possession of the grantor as a quitclaim and release.
Reservation of Life Estate: This section specifically states that the grantor is reserving a life estate in the property. By doing so, the grantor retains the right to possess, use, and obtain any profits from the property for the duration of their life. Upon the grantor's death, the life estate automatically terminates, and the grantee possesses the property in full, without any further legal action.

89-1-39. Effect of quitclaim and release. A conveyance of quitclaim and release shall be sufficient to pass all the estate or interest the grantor has in the land conveyed, and shall estop the grantor and his heirs from asserting a subsequently acquired adverse title to the lands conveyed.
Protection for the Grantor: Since the grantor retains a life estate, they can continue to live on the property and cannot be forced off by the grantee or any subsequent owner. The grantee cannot sell, mortgage, or otherwise encumber the property in a way that would affect the grantor's life estate.

The process was easy going. The process is one thing, the results another. I have attempting to resolve this matter, of claiming sole ownership of the property for several YEARS. I lost my Bride of 65 years in 2015. A lawyer I hired failed in his attempt, so I'm waiting to see the actual results. The form was easy to fill out. The only problem I had was on the Notary page I live in a different state than the property and I couldn't change the name of the state or county where the notary had to sign.

I am beginning to beliece that there is no search intrrfaxe here; just a long list of instructions full of circular references that simply tuns the researcher around and around to the same pages repeatedly. Order Process: 5 Stars - very easy Material Received: 2 Stars Issues: 1. Printing- Document would not print in format displayed. Format would continually shrink to approx 2/3 size thus not useable for formal doc submission to County Records office. 2. Document Format- Data insertion fields (addresses) were not of correct size for data input. I needed a 4 line input space but was limited to only 3 lines. Also, Date field (year) was mis-oriented in-so-much that the 3rd digit (inputted) overlapped on 2nd digit (pre-printed) and also was of noticeably different font. 3. Useability- Hand-written input space provided (for Notary) was deficient in space and spacing. It was a challenge to utilize the space available to complete fully and maintain legibility. Overall - the document worked marginally as advertised, I did need to re-write the entire document myself. It is a good concept but I'd recommend that Deeds company improve the downloaded forms for actual useability, readability, functionability. regards, Jim S
