This form is used by the lender himself/herself to release a Deed of Trust when it has been paid in full, even if the lender was not the original lender on the Deed of Trust in question. Once recorded - (attested by the clerk of the chancery court and discharge and release the same, and shall bar all actions or suits brought thereon, and the title shall thereby revest in the grantor.) (MS Statute 89-5-21)(1))
In general, the lender has (one (1) month after written request, cancel on the record the Deed of Trust) to avoid penalty. A Deed of trust in Mississippi can be released by the lender or by his/her attorney, this form is to be used by the current lender of record. (MS Statute 89-5-21)(2))

LOVE THIS!! I am a REALTORand from time to time I have had to take documents for filing. I'm so glad I invested some time online researching eFiling services. Glad to have all of the helpful extra information, even though they don't answer all questions for all situations. So, I accessed public records and asked questions at the auditor's office. Also, on my Mac computer, filling out the actual deed form is a challenge because the screen jumps to the last page everytime I try to type a few letters or hit the return key, so I'm rollling back up to the first 2 pages after most keystrokes. A bit annoying. Overall, happy to have these form options are available! There is really no need to wait and pay for an attorney when all the information needed is available via public records. Fill in the blanks!
