When Seller Financing is Preferred or Necessary.

When Sellers may offer this arrangement to broaden their buyer pool or avoid dealing with banks.

When Property is Being Sold “As Is”.

Often used in cases involving older or distressed properties where a conventional mortgage would be harder to obtain.

Investment Property Transactions.

Sometimes used in investor deals where holding title back until payment completion is part of the deal structure.

For Sale by Owner (FSBO) Deals.

Common in informal or family transactions without a real estate agent.

Land Sales or Rural Property.

Sometimes used when raw land or agricultural property is sold, especially if the buyer is planning gradual development. Use this form for residential property, rental property, Condominiums, vacant land, small commercial property and planned unit development property. For use in Missouri only.

Things to Consider:
Buyer Risk: Since legal title doesn't transfer until full payment, the buyer can lose the property (and payments made) if they default.

Seller Risk: The seller may have to go through legal action (sometimes similar to eviction or foreclosure) if the buyer defaults.

Recording: Buyer shall be authorized to execute and record this “Contract for Deed” or an “Affidavit of Equitable Agreement” on or after Initial closing.

It was frustrating to get the scans done but that might have been due to a learning curve. After 4 tries they were accepted. I couldn't figure out how to delete or close the failed attempts. Waiting to see if Recorder office has changed the title.

Overall positive experience; especially liked immediate access to downloaded documents and instructions. My only concern was lack of adequate space in portions of your beneficiary deed blank form which then required me to use 3 exhibits to complete all necessary documents for the county recorders office. I am a lawyer and purchased a specialized type of deed for a special scenario. The product received was functional, but not great. Wording is slightly clunky and the form layout was not convenient for making a professional final product. The wording also didn't contemplate a remote-state probate, which is a common scenario. Something about the PDF prevented me from doing cut and paste, so I had to do OCR to get the relevant text for inserting in my existing draft deed. Finally, while the site claims it is customized for the exact state and county, it does not appear to be well-customized for that purpose and I had to use other language (not sourced from the deeds.com document) to meet local norms.

Wow, great forms. They do have some protections in place to keep you from doing something stupid but if you use the forms as intended they will work perfectly for you.
