The Recorder of Deeds is responsible for maintaining real property records in Livingston County.

Recording Fees

To record the first page of a standard document, the fee is $24. Each additional page is $3.

The Recorder of Deeds will retain any excess payments up to $10 over statutory fees. This is intended to reduce the number of rejected documents and allow for the priority of recording documents. Overpayments of up to $10 per document will not be refunded unless a letter requesting rejection of the document is received with the document.

Document Formatting Requirements

* The document should be on 8.5 x 11 inch white or light colored 20# paper without visible watermarks or logos.

* Printing should be in dark or black ink and should be one-sided only. A minimum font size of 8 point is required. Non-essential information within any margin is exempt from this requirement. Signatures must be in black or dark ink.

* Continuous forms or those with permanent binding should not be submitted for recording; however, documents may be stapled.

* A document must be in the English language or be accompanied by a sworn English translation.

* Names are to be printed or typed beneath signatures in the document.

* Attachments may not be stapled or taped, other than a securely attached barcoded label. In this case, "attachment" does not refer to an exhibit, but additions to a document page.

* The top margin on the first page must be at least 3 inches. All other margins on this page and on subsequent pages must be at least 3/4 of an inch. Holes in the top margin (similar to those from a paper hole punch) will cause the document to be nonstandard.

* Below the 3-inch top margin, the following information should be given: document title, date of document, all grantors' names, all grantees' names, any statutory required addresses, legal description of the real property, and reference book and page, if required. If there is not sufficient room on the first page for the required information, the page reference within the document where the information is set out should be provided on the first page. If one of the required fields begins on the first page and continues uninterrupted to subsequent pages, this will meet the first page requirements.

* A cover page is not required, but preparer's may choose to include one, which will be recorded as the first page of the document. This will result in additional fees. The cover page must have the 3-inch top margin as well as other first page designations.

* Grantors and grantees must be designated in order to be indexed. There is no limit as to combinations or exclusions, but the designations must include the words "grantor" or "grantee." It is the filer's or preparer's responsibility to make the designations.

* Statutory addresses must also be designated, i.e. "grantee's mailing address..."

* The address of the property is not acceptable as a legal description.

If a document is presented for re-recording, in addition to all other requirements, it must have a new first page or cover sheet with the 3-inch top margin and the required first page designations.
