This form is used by the current Beneficiary/Lender or personal representative to release a Deed of Trust when it has been satisfied/paid in full, Pursuant to Mo. Rev. Stat. Sect. 443.060., which states that the Trustee shall NOT have to join in such Deed of Release.
In general the secured party has 45 days (30 days for a personal representative), after request to submit a Deed of Release to avoid penalty. [such secured party shall be liable to the mortgagor for the lesser of an amount of three hundred dollars a day for each day, after the forty-fifth day, that the secured party fails to submit for recording a sufficient deed of release or ten percent of the amount of the security instrument, plus court costs and attorney fees to be recovered in any court of competent jurisdiction. In the event a document submitted for recording by a secured party is rejected for recording for any reason, such secured party shall have sixty days following receipt of notice that the document has been rejected in which to submit a recordable and sufficient deed of release.] (443.170. I have used these forms now at least 3 times in order to sell the same parcel of land. The forms are great and I'm happy that I could use them more than once. To no fault of Deeds.com I used them many times to sell the same land. First the man died that was buying, before it got recorded. Then his wife was going to finish it, but then decided it should be sold to another party who was a friend of hers.

The process was easy going. The process is one thing, the results another. I have attempting to resolve this matter, of claiming sole ownership of the property for several YEARS. I lost my Bride of 65 years in 2015. A lawyer I hired failed in his attempt, so I'm waiting to see the actual results. I liked having the forms. Some may need to know they can look at the legal Description from online county records, then type up in Word document line by line, the degree sign in Word program is achieved by using alt and 248 on number pad. Then on the form page one write SEE Exibit A and title your Word program description as Exibit A. Goes without saying the legal description should be looked over many times and it is easier to do so if you format your Word the same lineage as the legal description online which is usually not text which is why you have to retype it.
