Montana's Affidavit of Deceased Joint Tenant

The Montana Affidavit of Deceased Joint Tenant form is appropriate for use by a surviving joint tenant, as identified on a recorded real property deed.

Montana Code Annotated defines how joint tenancy is created at Section 70-20-105 and the associated right of survivorship at 70-20-310.

Under 72-16-503, to formally initiate the process of perfecting the title, the surviving owner should complete and record an affidavit containing those matters required by 7-4-2613(1)(c). Among other details, this document should identify the parties, the property, and the recording information. Also include an official copy of the deceased owner's death certificate.

Submit the affidavit and any other necessary paperwork to the clerk and recorder for each county in which the real property or any part of the property is located.

This is an important step because it contributes to a clear chain of title (ownership history), which should, in turn, make future sales of the property less complex. It also serves as public notice of the change in the property's status.

We aimed to handle a survivorship affidavit (deed change) without a lawyer following my dad's death. After some searching, deeds.com seemed to have the most comprehensive and "correct looking" form we could find for our locale, so we went with it, and it was accepted by our recorder's office.

I'm not sure why our local government office doesn't offer a standard form, but they don't, and deeds.com came through for us in a pinch.

The Affidavit- Death of Joint Tenant form you provided is not the same form as showed on the Los Angeles County property tax website.
It appears that the LA county form requires entering additional info that is not included in your form.

The deed form is hard to fill in. There is no way to fill in the county in the "reviewed by" section. Also, there is no place for the Grantee's address on the form. I had to include it in the fill-in space for the legal description.

Your documents were very helpful. I went ahead and filled in all the info for the Release of Lien document. It was easy to do with your example. I had all the necessary info such as plot numbers, etc. for the property and everything fit nicely onto the document. It has been notorized and mailed. My grandparents' Victorian home has new owners who love it and has paid it off. Yeah!!!
