Under the Nebraska Statutes, the beneficiary of an interest in property may renounce the gift, either in part or in full (Neb. Rev. Stat. 30-2352). Note that the option to renounce is only available to beneficiaries who have not acted in any way to indicate acceptance or ownership of the interest.

The instrument of renunciation must be in writing and include a description of the interest, a declaration of intent to renounce all or a defined portion of the interest, and be signed by the renouncing party ( 30-2352 (2)).

Deliver the instrument within nine months of the transfer (e.g., the death of the creator of the interest) to the personal representative of the decedent's estate or the trustee, and file a copy with the court of the county that has or would have jurisdiction over proceedings regarding the estate of the deceased. If real property is involved, a copy of the instrument must be recorded at the office of the Register of Deeds in the county where the property is located in order to avoid any ambiguity in the chain of title ( 30-2352 (3) (b)).

A renunciation is irrevocable and binding for the renouncing party and his or her creditors, so be sure to consult an attorney when in doubt about the drawbacks and benefits of renouncing inherited or gifted property. If the renounced interest arises out of jointly-owned property, seek legal advice as well.

Really solid system for determining what may prevent your documents from being accepted. I love the comments section allowing for fluid communication. The service was prompt and attentive to my questions. I would've just appreciated a heads up that I also needed to contact the county directly (and provide contact info) to receive a certified copy of the document (Notice of Commencement) in order to submit the certified copy to the Building Department. This was an extra step that I haven't had to complete before using another eRecording service. Even if this extra step is a result of the county's system. I would still have expected a head's up (since there wasn't any info regarding this on the county's site for eRecording).

Extremely helpful team of professionals who are patient when you need to get things filed correctly. Very small price for the comfort of knowing your DOCUMENTS are FILED with you local Recorder's Office. Some of the filings, if they are correctly formatted are already uploaded and official within a few hours. Here's the ALTERNATIVE you may encounter. For Example: King County Recorder's Office moved which means most filings are backed up 7-10 days if you DROP your filing in a BOX with your CHECK or MAIL IT. Neither is a great option, since they have no WALK IN HOURS.

Good site. Two things to note. 1. The Documentary Transfer Tax Exemption sheet, the word "computer" is used when I think it should be "computed" Error in state form? 2. The California Trust Guide could have a watermark which is less distracting. Kind of hard to read the print with the DEEDS.COM logo so prominent.
